Primary Applicant: name (spouse), I-140 EB-1-EA (Priority date 4/1/2002, approved 8/20/2002)
Dear Congressman,
I am so and so..... My spouse’s I-140 application [EB1] was approved on Aug. 20, 2002 and I-485 application for permanent residence was approved on 10/31/2005. At that time, I was ineligible to apply for I-485 (i gave the reason why). Subsequently, I filed I-485 on June 7, 2007 as my spouse’s ‘derivative’ to the Texas Service Center. I completed fingerprinting on July 17, 2007. The latest ‘June 15 Processing Times’ for the Texas Service Center show ‘July 17, 2007’ as the current processing dates. This is >30 days of my date of application (I-485, Receipt date 6/7/07). The priority date for EB1 is current for India (fact), and since my spouse’s I-485 has been approved since 10/31/2005, a visa number should already be available for me as derivative (fact). My understanding is that USCIS could adjudicate applications even if security checks are pending for >180 days (fact). I have been in the US for 14 years and I have very cautiously maintained legal status all these years. I would very much appreciate your help in investigating the delay in the adjudication of my I-485 application.
