Trying for Re-issuance of H1 B via Canada: Jim/Jaxen/ other gurus please help

Hi There,
I have read the article on muruthy regarding "Contiguous Territory" Rule. I have a valid 1-797 & I-94. I have not left USA since almost 3 years. I have never been out of status. I have all my papers & are straight. My visa stamp on passport has expired since more than an year. It was my ignorance on that part. I cannot do my re-validation from st. Louise. If I go to Canada for re-issuance of visa, would there be any problem? Can my visa at canada be denied for any reason? Can anyone please tell me risks involved?

Risks...

If your degree is non-us there is a big risk of your visa stamping denied at all US consulates in Canada.
And from Apl 1, you cannot enter simply using a valid I94.
The only option is for you to travel to your home country or some other US consulate in europe and try stamping for TCN.

I want to get this done. In addition, what if I have to travel outside US. In that case I may have difficuilty coming back.

It seems that you are creating the very situation that you are trying to avoid

You\'re travelling outside the US (and you may have problems) so that you will be able to travel outside the US and avoid problems.

Why not just wait until it is really necessary?

H1 Stamping outside USA

I am in the same situation. I have to visit our factory in Mexico. To visit the factory in Mexico, I have to get a Mexican VISA. To get a Mexican VISA(to visit the factory) I need to have a current H1B stamping on my passport. My H1B stamp in the passport expired in July 2000. But I was never out of status. What are my Options. Please respond.

dont think expired h-1b stamp matters

almost same situation with mine. H-1B stamping expired. Wanted to stop over in UK enroute to india, so had to get a visitor\'s visa to UK. Sent them the current I-797, and I-94,etc. Got the visitor\'s visa to UK even though my h-1b stamping had expired. I think if u r in valid status in the US that is enough.

Similar situation

Hi, i\'m going up on this Monday for my H-1B visa and I\'m in a similar situation in that I don\'t have a valid visa but I have always been in status (J2->H4->F1->H1)and I have a U.S. college degree. Is there anything apart from that if my paperwork is in order, for risk?

I have all supporting documents that show me being in status while on J2 (IAp-66), H4(i797/i94), F1(i20/i94) and H1. Is there anything else?

going to canada.

Going to Canada for re-stamp... My visa is still valid, got another job, and the h1-b transferred, but want to get it stamped in Canada,
any problems or anything that I need to take... I heard u cannot enter back in US, if u get rejected... but i still have a valid visa till Nov\'02... any problems... thanks.
