Trip to India Using AP

Hi,

My I 485 still not approved my rd is 11/15/2001 and ND is 12/11/2001 , I wanted to go to india using advance parole
Travelling with AP is safe or not MY H1 is renewed but not stamped and also FP is going to expire july 25

Thanks for help
 
It is safe.. But, carry along all the necessary documents like

I-485 receipt document
Advance parole document
regular passport/visa/etc

I did not travel but know who travelled and came back with out any problems.
 
You shud be fine.....

Just forget everything and go .. Eveything shud be fine. Just make sure you carry all your supporting documentation along with u. Stuff like Original receipt for 485 application, I 797 for H1 B( Not needed , no harm in carrying) , Birth Certificates, Marriage Certifciates, EAD etc........

AP is not safe if you have stayed illegally for more than 180 days otherwise AP is fine.

But I think starting August 1st it would be very difficult to get H1B visa in India.

AP is not a guarantee that you can re-enter the U.S.
Those who are subject to 3- and 10-year bar should NOT leave the country until they have received the I-551 stamp on their passports.
 
I have used ap twice. There shouldn't be any problem unless you were out of status for more than 180 days before. But try to avoid frankfurt if so, get transit visa for germany.
 
This year Jan I travelled to India on AP. I didn't had any problems. While returning r u planning to come on AP or H1. If you are planning to come on AP after Juky25th, then it will be a problem, because of ur AP is going to expire on 25th.
 
question?

What if you get approval while you are gone? Will the AP still be valid? I thought AP is only valid till approval. Also, what if you enter on H1B after 485 approval?
 
What if Approved when we are out of US using AP

Can anybody answer this if person is out of USA and his case is approved and he had used AP to go out

Your AP should be enough to get you in. You may only be paroled for 30 days, but that'll be enough to go and get your passport stamped. Even if you attempt to re-enter on H-1B, the BCBP folks at the airport should parole you in.
