trespass expunged 2 years before citizenship apply,help plz

hi,I had a TRESPASS 3 years ago,expunged 2 years before by the judge and I can apply now for citizenship after 5 years of gc. I wanted to know
1.can I apply right know for citizenship without any problem or I should wait 5 years after expunge date which was on sept 2008 to apply for citizenship? which one is correct?
2.if I apply right now after 5 years of gc and 2 years past from expunge,do I need a lawyer or is it going to be a smooth process without any hassles?plz help,regards.
 
An expunged case is still considered a conviction under immigration law. Depending on what the exact charge was and possible sentence will determine if you can apply now or wait to apply 5 years after conviction date.
 
What was the initial conviction on record with the criminal court? Remember that USCIS tend to take a hard line on most conviction.

1.five years from 2007 conviction date or 5 years from expunge date sept 2008,which one is correct?
2.is it safe to apply now or I have to wait till 5 years from one of these two dates?which one is correct?

I'll say it one more time: 5 years after conviction date. Expungement date is not used for immigration purposes.

You have to demonstrate good moral character for 5 years. In your case, you are looking at 2012. In the meantime, don't engage in any illegal act which will require probation, each time you are convicted, you reset the clock for naturalization. However, for some crime, no clock is reset, you will serve time and be deported back to Bangladesh...lol!!!

in 2012 after 5 years of conviction for trespass and expunge,should I pay and get a lawyer for citizenship interview not to get revoked? or can I go to interview as a normal person like others and describe all that happened to the officer?if not getting a lawyer is it safe for my case?plz help.regards.

In planning ahead, you could save some money and engage the services of a good immigration lawyer, if this will give you a peace of mind. In reviewing your case, the initial conviction is lesser than the original offense, you did no jail time, which was good for you. You can apply in 2012, after demonstrating good moral character and no further trespassing of any kind, for naturalization. IMO, you don't need a lawyer to do this filing because your conviction is less egregious unlike running a nun with a car, while driving on a suspended drivers license. Your green card will NOT be revoked for your offense, just relax.
