Travelling while I-485 is filed

Hi,
I got my I-140 approved and I am due to apply for I-485. I also have to go to India in June(It is urgent). I understand that by June I will not be able to get EAD and AP. So, Can I go on my H1(it is valid) and come back on H1? Are there any issues? Please advise.

I-485 vs CP

Hi,
I got my I-140 approved. My I-140 indicates that it is approved for I-485. However, I was wondering, if I change to CP option, will it help me to get my GC faster. I am in California.

1. You can use a valid H1 for travel. Just make sure that while applying for I485 you have a valid and clear I94.

2. You can download and apply for I824 instead of 485 now.
CSC is clearing cases faster than any other service centers. (3-9 months!!)CP will also take 6-9 months.
 
Hi Jaxen,
I have my clear H1 and I-94 so I guess I can travel. How about my wife- She came to US on H4. While in US she got her H1, worked, lost her job and applied for H1-H4 transfer. Her H1-H4 transfer has not come. Her passport has stamping of her previous H4. Can she also travel, while our I-485 is filed?

If she had applied for H1 to h4 transfer and she travels her application will be considered abandoned.
However, with your valid H1 stamp, she can get a new H4 stamp and then reenter or can show her old H4 (still valid) and enter.
I saw a suggestion in usvisanews.com/ wednesday questions about a similar situation (see the archives- few weeks old). Please read it to know whether she needs a new stamp or not.
