Travelling to Canada - Part 2

I have seen in the forum where the general recommendation seems to be "use your H1 if you have that worst case use your AP"

Why is that so?

I am on H1B but my visa and I-94 expired in Sept 2002. I do have new form I-797 and I am planning on making a trip to Canada. Is there something that I need to be aware of?

So if I plan on making a trip to CA on AP do I have to surrender my expired I-94?

BTW I am travelling to Canada to land as Permanent Resident and also plan of returning immediately.

Thanks, vk

Thanks for your reply. I was wondering since I have AP why not use it?

I still dont know why its preferable to make the travel on H1 than AP?

Actually after reading the threads in Canadian Immigration->Travell and Visa Issues; I figure that AVR (Automatic Visa Revalidation) has caused issues to some of the folks. Since AP seems to be better option in that case why not use it?

Please let me know.

Thanks, vk

I think you can use AP, only if you are on EAD. Please confirm with your attorney.

You can use AP to re-enter any time you want. Once you have used EAD, however, you will need AP.
