Traveling on AP question

Maybe somebody can share his/her experience regarding following questions/concerns:

I'm going to travel in 2 weeks outside U.S.
My H-1 expired on Oct 2002, so my I-94 did.

1. When I leave U.S. and surrender my I-94 card, would this raise any questions? Should I show them AP?
2. As per mentioned above, will I have any problems in other country boarding on the plane back to U.S. because of expired visa?
I believe immigration officers in 3rd world countries don't have any clue about advance parole, and they must not allow people to get on plane to U.S. if they don't have valid visa in their passport.

Please share your experience.

they are well aware off AP and EAD

u need not worry.as long as u have AP .U will be able to come back.though do take with u EAD,company letter, salary stubs,485 application.

Thanks for the answer.
I understand that I need the documents you listed upon arrival to U.S.

But my question was whether I'll get on the plane to U.S. without problems if I have no valid visa stamp in my passpord.
U.S. enforces strict rule to charge $20k from airway company if they transport to U.S. people without proper documentation.
I bet many 3rd world countries have no clue what advance parole is.

Can somebody please share his/her experience regarding this matter?

If you read the AP document carefully it says clearly that the airline will not be penalised for bringing a alien who does not have a visa . AP is suppose to be a substitute for a visa.

I had the same concer but my lawyer adviced me to carry 485 rcpt , EAD , Letter from company etc to justify your legitimacy .

But real life experience may be totally different . Even I am concerned as I am travelling on AP .

The other issue for which I could not get an affirmative answer for the requirement for a transit visa for europe if travelling on AP . Guess better to check out with the consulate.

It would be really helpful if others could share your experience as this is a busy travel season and many of us are in the same boat travelling on AP with no visa or expired visa on passport.

slacker48,

You should not have any problems as long as you provide proper documentation.

I was overseas in August and stopped in UAE for a few days. Returned to the US on Malaysian Airlines. The security was extremely tight taking into account the airline and origin of flight. I had 3 layers of inspection and even the check-in luggage was opened. However, no questions asked on AP, tho' it looks like a silly, easy-to-copy sheet.

Got back to the States, GC aproved and now have the Plastic in hand.

Get all the advice from you lawyer before you go. Carry all necessary documents.

Good Luck!

My spouse had travelled on AP , the visa stamp on the passport having been expired. did not have any trouble with the immigration authorities regarding AP. They probably have another counter /area /room where they stamp the AP and take one of the originals (out of the three).

I was wondering if you changed employer during the 485 and are travelling on AP, will there be any problem in regards to Employment letter, payslip etc. As the payslip and employment letter may not match with the last H1 Visa stamp on your passport or it doesn't matter as EAD and advance parole doesn't name the employer...

Any advice?

Thank you.
