Travel with I-551 stamp after interview

Hello,

we are planning to go to india with I-551 stamp for my wife and I already received my physical green card. USCIS says they are still waiting for my wifes file for card production from Dallas district office where we had our interview and still her status shows case pending for the interview in their system. Our I-485 Was approved in january this year after the interview. Do you see any problem for the travel for her and she will be travelling with me while coming back..Do you think she might have any problem at the US Airport immigration while coming back to US.we dont have any extra proof like welcome notice other or the approcal letter other than the copy of interview letter and I-551 Stamp in the passport..Please suggest..

Case History:

Applied the I-485 in 2002 at Texas service center and got transferred to Dallas district office for interview.. I-485 approved for both me and for my wife at the interview in January and got the I-551 Stamps for both of us.Waited for 3 months for the cards and finally got my physical card on May 10 th,2005. Contacted the Dallas district office thru attorney for my wifes card status and got the email response to my attorney says that they transferred our A-files for card production on the same day together.

Waited for some more time and called the USCIS and they don't see her file has bee transferred and still the I-485 status showing pending for interview.Filed G731T but no response..Every time we call USCIS the same answer wait or go to Dallas local office..We moved from dallas area to charlotter area but all our mailing addresses are my attorney's.

Waited until July and my attorney suggested us file I-90 for the card that has been never received..we filed I-90 on july 7th and so far no luck on biometrics appoinment other than receipt notice.

My attorney is not helpful any more because as far as he concerned he is only responsible until the I-551 Stamp (I also paid him for attending the interview even though my case is striaght forward just for peace of mind sake.. ) and we moved to charlotte area its hard to see him personally..

What do you think..Is it ok to travel? Do you see any problem..

1. if you and your wife have passport stamped then you can travel and can come back to US
2 it seems that the local office where your Interview was conducted has not sent your wife file back to service center and has not sent the white form where you wife signed and gave index fingerprint for the cards( I am confused becase you got the CARD and only wife card is pending, your wife I-485 was in your file and if the service center sent your card how they are saying they have not got the file from local office. I suspect the local office or service center office lost your wife white form that is for card processing and local officer did not update the USCIS computer system or Local office has nt sent your wife white form to service center. did your wife gave signature index fingerprint and 2 photographs, if yes then her white form is missing and local office visit is need from your wife side, so that the local office can again take her fingerprint, signature 2 photographs
3 while you come back your wife may be sent for secondary inspection and it is not a problem
** if you serach past threds same happened with other person and he waited for card more than 2 years and he involved his congressman office and then got the Card
** Lot of confusion with I-90 at this time
** did you update your wife NEW address by writing letter to service center?? if not then send letter, write her Name, A#, DOB, I-485# new adreess and past address also write that her I-485 was approved on date... by local office..... and her spouse primary applicant..... was also approved same day by local office primar applicant.... I-485# has got the card and her Card is still not recieved and card should be sent to new address , she need to sign the letter. write to them with certified mail (keep the copy of letter for your records)
*** did both of you file form AR11 after you moved?( FYI the form AR11 does not change address on pending petitions)
** keep the copy of interview date notice with you as proof

1)Yes.. I received my card and my wife didn't. Also we got the email confirmation from the Dallas local office to my attorney(my attorney forwarded me the repsonse without the USCIS reply email address) says that both the A-files were transferred for card production..

2) Yes..I sent the AR-11 for both of us long back.Since we have my attorneys address as our mailing address(since day one for our green card processing and even my green card also) we didn't have to change on the applications.

3) Anyway I am also planning to send the AR-11's one more time since we didn't keep the proof (receipt)..

4)You said Local office visit might fix this problem.. Does it have to be Dallas Local office or it can be charlotte local office where I am currently living..

5) Both were stamped with I-551 on the same day and we have all the copies
of Labour,I-140 approvals and interview notices.

6) Yes..I am also following up with the congressmen to expedite my I-90 and also I explained the whole problem, hopefully one of them will fix this problem..

I am in this country for long time and we paid so much money to the attorney for 4 times ead's and parole visas renewal, interview appearance..
and still If I ask him any cocerns I will get one line reply which leaves me with more confusion..Thats why this country will be never my home because it is so materialistic and they make you one eventually(I hate bitching since I believe in if you don't like it,get out don't bitch about that..)

As long as it doesn't impact our travel I can wait for some more time and fix this problem..this is very very frustating but thanks for the reply..

For got one more thing..

Yes..The officer got her signed and took the index finger print on the white form(I believe its I-89 EXCUSE me if I am wrong)..

---------------- AR11 is for your address not attorneys address you dont stay at Attorney address . Card is sent to address the address provided on I-485 or if at the time of Interview you informed the officer about your address. Card is sent to address that is on I-89

------------- you both need to file AR11 and provide YOUR address(it will not change the address on pending petition with USCIS or on form I-89
