Hello,

I have pending I485 application (PD not current).
I have approved H1B Notice, but do NOT have Advance Parole.

1. What is the risk in travelling outside US on approved H1B Notice only (visa stamping required) without Advance Parole ?

2. How to get Advance Parole at the earliest ?

I will apply for Advance Parole when get AP approved in hand then go for H1 stamping.

I was told by someone that, if you file for Advance Parole and leave US, you can NOT use that Advance Parole to enter US (as it was approved when outside US). Correct ?
Can US consulate issue Advance Parole ?

when file the AP write on Cover letter what is emergency. with infopass you dont get AP quickly. you need to file AP where your I-485 is pending.
 
My last year AP was resubmitted to USCIS, for correction. I has been with USCIS for last 6 months.
There is wedding in family on Apr 4. Can mention it in infopass (comming week) and get AP ?
What are my chances ?

wedding is not emergency and with infopass local USCIS office will not give you AP.

What happens if the consulate won't give you the visa (security check, missing documents, etc.)?

-----------------you dont need H1 approval notice or advance Parole to go out of US. You will need passport or visa for the country you are visiting or going.

i.e. for reentry into US visa stamping at consulate would be required.
----------------------for reentry to US you will need valid US Visa stamp or valid AP or Green Card or US passport.

The problem is rentry in US if left US with only with H1B Notice, without Advance Parole.
(old H1b stamped on passport expired, No Green Card or US passport)

No, the problem is re-entry if you don't get the stamp. Whether you had a stamp or not when you left is irrelevant.

That's correct.

That's an interesting question. There's not really much case law to suggest what'd happen. I think your bigger worry is what to do if there was an RFE or interview.

You had H1B status when you left the US, so your I-485 would not be considered abandoned when you left the US, so you should be able to use the green card if it is sent to you.

Otherwise, if you get the stamp before I-485 approval, you can use the H1B stamp to reenter the US even if your I-485 is approved in between the time you get the visa stamp and the time you return to the US. They will send you to the secondary inspection room to process you for GC status.

Someone said that in such case, USCIS would consider I-485 abandoned and deny it (even if PD in NOT current)
