Transit visa question - Frankfurt

Hi,

My wife is travelling to India via Frankfurt next week. The H4 stamp on her passport has expired, but her I-797 (and I-94) are valid till Sept, 06. Do we need to get airport transit visa for Germany? The information on the German Consulate is confusing.

Exemption 4 to the list above

the exemptions under no. 1.) apply. In addition, please note:
Indian and Turkish airport transit travelers who
- are holding a valid visa or other residence permit for the USA (an approval notice is not sufficient), Canada or Switzerland and travel to the country which issued that visa or residence permit

or
- after a legal stay in the USA, Canada or Switzerland- return to the country whose citizenship they hold
do not need an airport transit visa.

Which air line? If it is Air India /Lufthanza and the trasit is with in the air port, you no need of transit visa. if you are going to stay outside airport in a hotel you need transit irrespective of your pp.
