I am very sorry to say that the answer to your second question is "no". Our law firm told us that DOL definitely can reject LC, especially under the current national unemployment figures. A coworker of mine actually told me that some of his friends (in both CA and TX) have been denied of LC. our lawyer also said that the only purpose of DOL is to protect US workers.
I think I will at least get RFE\'s if not rejected at the first round. And this is why I think my chance of getting LC is very slim:-( but for those whose company has not had any layoffs, the situation should be better. Anyways, I wish all of us the very best luck.
