Tracker: Waiting for Derivative's I-485 Approval

You got me wrong, I was joking for analyzing SR responses with others experience. I was never able to understand how they work, every case is different. I am with you, one should not leave any chance to raise SR, visiting Infopass, calling TSC IO's, congressman inquiry.

:D

But from people's cases, I too decided that SR is just to make sure if they haven't misplaced or lost our files... and force CIS to open and touch them. So we should probably keep our expectation low as to what SR can actually help us with, but then again, to confirm they haven't lost our case IS important, because they do now and then (seriously).

Finally I got the RFE details of my spouse from my employer yesterday after following-up closely as I am not supposed to interact with my employer's lawyer directly.

And the RFE is for TB skin test. I have scheduled an appointment with a civil surgeon today.

GOOD LUCK! I'll keep you posted.

Thats good, somebody is working on the case, good luck.

It is illegal for your employer to have your i-485 routed to his company authorities.

Thanks StillAlive.

sarwarmd,
My employer is a customer to the law firm and itseems any inquiry from the employee
has to go through the employer. Its ridiculous. Thanks.

Have called TSC re: wife's case. A very polite IIO told us that
- visa# has been requested but not received yet (does anybody know how to call DOS and follow up with them? ;-) just kidding... Well, if I knew the phone# I would call. Seriously).
- no imm.officer is assigned
- if nothing happens in 60 days, then call back (no indication about SR submitted by lawyer in beginning of Sep, which anyway they have not responded to yet).

Well, not much information, but looks like my wife's case was sitting in one of the "wait-until-October" boxes.

"Visa number requested" was the slogan for my spouse case in September. I didn't call this month, but asked my congressman to follow up.

No need to call DOS, I tried that number before my approval, they have no clue about our cases. They might have information about VISA number assigned for consular cases. One more note you need a case number to talk to them which we will not have.

Good luck, keep trying other avenues and update us :)

Yeah that's how I understand it too. I read one such post here before.

"Visa number (not) requested" and "visa number (not) allotted" drove us nuts too. I am under the impression that they are working on batch-basis, and if that's the case hopefully you guys' spouses are put in the next approval batch.

hello.mohan
that's a definitely positive sign. Keep us posted.

everything seems a waste of time

Hi guys,
It is a little reassuring to see at least a few old timers here still! I have been away for a while, as I didnt have anything to report. Since my last posting (about infopass and SR opened), we had written to our senator, a congressman and the FL about our case. In response, we got 2 letters from DHS.
The first one was addressed to us, but had details about a completely unrelated application. The application # was different, it was a family based category and belonged to CSC. DHS was being efficient I guess.
The second letter got our vitals right, but informed us that " our application was within the current processing time limits". Whatever that means...

Meanwhile, no change in online message. Seems to be the end of the road to me. Just waiting and watching now. Cant think of anything else.

I would send a formal complaint to the USCIS-HQ re: Incorrect information provided. Not sure how efficient it might be, but I've read about such things before. In some cases USCIS apologized and reviewed the case status carefully.

anya4ever you really scare me. Are you waiting for spouse approval since 2 and half years. That is ridiculous. Probably we should lose hope too.

How could it be? Your spouse is way out of the processing time, or am I missing something?

Anya, have you written to CIS Ombudsman? Such cases as yours should get his attention. I would write to his office to explain all those things (including the complaints re CIS gave you wrong info) and ask for their assistance about the spouse case. How much it might help, I don't know, but they are generally responsive unless it's a stuck-in-name-check case (in that case they cannot help).

I'm here too :-(

Ever considered filing WOM? Looks like people are still getting the result they want and you might want to researching that possibility, including benefits and risks involved (you probably need to have a stronger case than before, but if stuck in NC since 2004 is not strong enough, what is).

wom?

what is WOM?

anya4ever and srichalam, what is the secret behind waiting this long. Are you not taking it seriously? This way you will need to wait long time for citizenship even after your spouse gets Citizenship. Won't it hurt long terms plans.

I called my congressman today to follow up about my spouse case. They said just received response from TSC, that her name check is completed, that is a good sign, we will follow up for the rest.

All the frickin Infopass visited so far keep saying all security and name check clear.
They will send written response to me, I don't know this will carry any proof that namecheck was completed.

Waiting continues.......

Guys,

I am very very longtime waiter, I am here waiting more than 3 years after my approval. My spouse case is very very simple and stright forward - BTW namecheck has been cleared long back as per 2 infopass requests and 2 IO's.

I tried everything except WOM.

I do not know what is next.

Thanks

Why would the primary applicant (who has been already been approved) have to wait a long time for citizenship even if their respective spouses are not approved ? Or am I missing something ?
In fact, if they become USC, then their spouses' cases will be given a different priority (no retrogression attached).
Btw, I have been waiting 2.5 yrs for my spouse's approval too, but there are very few things one can do. We have tried all the usual stuff, and at this point I am not sure we want to get into the hassle of approaching the court just yet.
