TO: my140denied

Hi, Here is what I saw online about Texas Center. I am not sure it would be the same for California or not. Just copy it here FYI.

If my I-140 is denied, can I appeal the denial to the AAU (Administrative Appeals Unit) and then file the same case again to INS?
In the past, I would have said “yes,” but according to the Texas Service Center, the answer now seems to be “no.” INS is now cross-referencing appeals and if they know an appeal is pending they will refuse to adjudicate a re-filed case in the same category. Furthermore, appeals at the AAU can now take three years, and with all Employment Based (EB) visas now current, the strategic reasons for appealing may be gone.

Do you have any news regarding your cases? I called to my lawyer, and asked him to send fax inquiry.

its a long wait..and no news from INS
let us know what responce u get .
my attorney told me to wait for one more month.

My I-140 has been denied.

EB-3
Labor Substitution

INS Says: Education does not match what was stated on the original AEC.

Original AEC: BS in CS/CE/EE or RELATED DEGREE

I have:
Equivalent of BS in CIS (eval from two different sources)
MBA

I guess I was just unlucky. Hope some of you have better luck and get a less anal officer and who probably understands that CIS is related to CS.

Any ideas on average time? The document received says 158 days and 60 days and I assume that is the max and min processing times.
 
Hi, my ND is 1/9/2003 and I am still waiting... not sure if the 158 days is a max estimate - with INS there is no max. you just wait.

Does anyone in the start-up company get 140 approved?

Usually start-up company's net income is negative.
 
INS can ask for anything. You should go over to the 485 forum which has more senior members who have been waiting for a very long time.

Whenever i come to this forum, i feel like people ask very naieve questions :)

INS can even ask for something again, even though you clearly submitted it. it happens all the time.

NEVER give INS the benefit of the doubt, they're screwing up more often than not.
