Looks like what you thought would have happened (all I-140's LUD changed to 09/14/2004) because of system upgrades is incorrect in my case. My I-140 still says 12/2003....
 
Thanks an_anonymous and takegc for your input. My LUD was 04/20 rather than 04/14 so it looks like somebody did look at it.

Was a I-140 approved for the original beneficiary?? If so, was that original approval letter attached in your I-140 petition??

Okay Guys,

I think USCIS finally started working and perhaps thats why it took them long time to put new processing dates. Well i am glad to see that my I-140 EB-3 RD 09/15/2003 has been approved, no RFE and mid size company. It was a concurrently filed case but I-485 is still pending and i am not sure if its pending based on FBI check.. here is snap shot of i485

On April 17, 2004, the results of your fingerprint review for your I485 Application to Register Permanent Residence or to Adjust Status were received, and processing has resumed on your case. We will mail you a notice if further action is needed, or when a decision is made.


Good Luck Everybody, one hurdle is over and now moving to next

Since you did not have the original LC, it makes me believe that there was a previously filed I-140. In such circumstances, I personally feel that if you enclose the approved I-140 petition and also the letter to withdraw that I-140 and if the original beneficiary has not filed I-485 (Adjustment of Status) and if this is cited in your I-140 petition, it might remove any doubts on your case as all facts related to the previous petition are attached with your application. Again, when the adjudicating officer in your case sees the previously filed I-140 approval original in your file, it would make things little more simpler (just my imagination.....) to retrieve the original LC from the previously filed and approved I-140 since they have that information with them in your file.

Please note that these are just my thoughts only.

Anyway, I will be interested to see what you find out about a previously filed I-140 and its status....

Congrats t22, seems like we are in same boat, concurrently filed i140 approved without RFE but no news on I485.. hope this journey gets over soon........

Hey guys,

My RD is Sep 03. 2003 EB3 non-concurrent. I am seeing a lot of approvals but they are all concurrents. What is the oldest date in EB3 Non-Concurrent category still waiting to hear from CIS on this forum?

Could you please let us know whether your case is semi concurrent or concurrent(sent both I140 and 1485 in one cover)

Has anybody with semi-concurrent cleared their i-140 recently

quick question for you. In ur application for I-140, how did your company
provide the proof for ability to pay. Is your company profitable enough to pay for salary or were you already getting paid the LC salary from the priority date or did you have to use both salary and company's income to cover for the LC salary. did your Last Modified Date show any changes in the days before the approval ?

I140/I485 approved

want to share the info with you guys.
concurrently filed EB3 I140/I485, RD 08/19/03.
got a mail from USCIS(and my lawyer) that both got approved on 09/17/04.
not sure what's next. but thanks to this website for all the support over 2.5 years of labor and more than 1 year of immigration petition.
 
congrats too all those who got approved.

I do see some of us who got i140 approved but no news on i485, i hope the wait is over soon....
 
1-140 still waiting

my RD on I-140 is 21 oct 03 but still waiting. I have seen few cases with RD in oct got approved even though CSC shows that they are processing Aug cases. what is the mystery ?? any idea ?

mine is concurrent filing. 485 and 140 sent in one pack.

any clues guys ??

Hi Guys,

Finally the good news came in today, I485 got approved after few days of I140 approval and this long journey comes to an end. This forum has been a great help and i appreciate everyones effort to help others and i hope it will keep on going. Many thanks to Mr Rajiv for running this great forum
