Tracker for appeals/MTR

Sorry to hear that. Did your online status change? I saw your earlier post that you didn't see any LUD after 16th. My LUD changed 11/17 and 11/18 and finally it says: "we received this case back from the Administrative Appeals Office. If any further action is appropriate, we will notify you when it is taken."

I know the deicision is close, just too anxious to know whether its good or bad.

I have a similar situation.

Box 14 Masters with 2 yrs experience
Box 15 Will accept Bachelors or Equivalent in science with 5 yrs progressive experience.

I have a 3 Yrs BSC in Stats and CS and a 2 yrs PGDBA (MBA).
Got an RFE to submit additional evidence that the beneficiary has a single source edu qual. Responded to the RFE with an eval from Sheila Danzig and requesting to be approved as an EB3 if NSC does not accept EB2. Waiting for a decision from NSC.

If they Deny, can I try MTR/Appeal or is it better to give up? Your advice will help me make some decisions.

My appeal application (on I140) is pending at AAO since mid-October (Moved from NSC) on A2P issue.

Thanks!

LUD: 11/23/05
LUD: 11/25/05

Any clue?

LUD on my I140

Gurus,
There was LUD on my new I140 on 11/16 and 11/17. But there was no change on the status. I heared from others that when there is no change on the status it is mostly denial. My previous 140 got denied without any RFE for having 3 year Engineering degree. That time also I did not have status change.
This time I had my B.Tech 3year degree evaluated to US B.S through Trustforte. I hope atleast I should get an RFE.
So far my lawyer hasn't received any letter. Do you know how long it generally takes for the lawyer to receive the letter? If there is no status change do you think it would be a denial? Can you guys give your opinion about my case. Thanks for your input.

Thanks.

Online status does not change for denials.

I think my denial letter was received within 2 weeks (may be less).

No, it can just be regular processing. May even be a RFE, but can be a denial also.

While filing 2nd 140 on the same LC (?), did you mention that previous 140 appeal is pending at AAO? If not, then this may be a RFE to ask you about the details of previous case.

Hi EricS,

I think one cannot able to file 2nd I-140 on same labor (when it's already denied and it's in MTR/Appeal), without withdrawing the MTR/Appeal...right ?.

Thanks.

EricS,
Thanks for your input. I hate to see a denial on my 140 without an RFE. I think my lawyer mentioned the previous 140 case no on my new 140. I hope this will be atleast an RFE. I should know something this week.

Thanks

One can do so. I think one such case is mentioned in UNTEDNATIONS 'Ability to pay' thread.

LUD and message changed

I had filled for appeal a month ago after getting a denial on my I140. Today the LUD for my I485, 140 and I129 changed together. Also my I485 message changed and I got an email for it. The new message is "On November 30, 2005, this case was reopened on a BCIS motion, and the case is now in process. It is taking between 570 and 600 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.".
The message for I140 and I129 is still the same. Is it a good sign or a bad sign. Please share.

That means your MTR is approved. They will not reopen your 485 unless your 140 is approved. You may get emails tomorrow for your 140. I am very posititve about this.

I have filed MTR on Sep12th and still there is no LUD change on my case.

Hope you will get emails soon about your 140.

So Good Luck !!!
