Tracker for appeals/MTR

hi,

I am just curious to know how many are on their 5th year of H1.I also got my 1-140 denied and my lawyer said it will take a year to get an answer form the appeal.I appealed in nov'04.

Why is this the problem only for the EB3.So please if u can let me know I just want to see if there is any connection.

Hi unitednations, may I ask you a question?
My case is that I and my attorney never received the requist of RFE and NOID from NSC for my I485 case, and no message changed on the website either! Finally we got denied since we "did not have any responses". So we filed MTR on Feb. 1, 2005, LUD is Feb. 4, 16, 17 and stopped, I called them and knew that the MTR was approved on Feb. 16, and now the case has been being reconsidered, but no any message updated, and the I485 message no change either, do you think they opened the case? Why there is not any message changed? As I see many people got email to tell that the case has been reopened but it is not on my case, is it normal?

any LUD changes on 485

Are there any LUD changes on I485 or I140 cases? I did see continues changes on MTR and I140 then stopped after few days. I don't see any message changes. I never called them after...your case gives me little hope.

what about LUD on 140 & MTR?

Thanks for the response. Did you observed LUD changes only on MTR or even I140? Let me know in detail how you initiated this call and what they said? Did you asked them when can you expect the official approval notice?

Hi SaiGC2004, I see the LUD only with the MTR, not for the I485. Tried to call them but very difficult, and they could not tell when you can expect to get it approved!
 
I140 and 485 Reopened

Hi Folks,

My I140 and 485 cases are reopened on a BCIS motion. Any Idea whether now there are any chances of denial again or will it get approved. If Approved, how long will it take?

Congrats !, If it's reopened on BCIS motion, then it's a good sign, and you will get approval soon.

Thank you. Yes, the online messages for the I485s all changed to"this case has been approved......" but the MTR message didn't changed. Actually I called last month and I knew that my MTR was approved on Feb. 16.
I don't know what situation is your case exactly, but I do encourage you to contact with your service center, it is not easy but you would have some nice persons who are willing to check and answer your concerns!

can't do another case status referral

I just called customer services for another case status referal on my MOTIC MTR which was filed in 07/2004. I was being told that it is with the commissioner for decision and I have to wait. I can't do another case status referral. I first enquired about it in DEc'04 and got response saying it may take some more time. Later after a month, I found many LUD changes on MOTIC, denied I140 and never got any message online or letter. Fewdays ago I called them and they said I can only do the case status check only after 60days. So I called them again today but this representative told me that I can't do anymore case status checks until a decision is taken. kind of worried.. I dont know how longgggggggggggggggggggggg.............

Hello SaiGC2004, sorry to see your frustration. I don't know the details of your case, so I just say something by guessing, did you file APPEAL or pure MOTIC? If it is an appeal case, it might take a little more time than MOTIC, but may not. And don't take seriously about what they told you, I felt bad when they showed me cold face, but I have to call them, it is not always the same answer. some customer representative is really nice. Don't give up. Your case will be approved. The real good sign is that your case has been reopened?(Am I right), if so, they will approve it once they reopened the case!

Thanks for your supporting words. IT is a pure MOTIC. but pending since 07/2004. I am not sure whether it is re-opened or not. But I have seen LUD changes in JAN for 3 continuous days on MOTIC and later LUD changes on denied I140 for 2 days. But there is no message or any communication. Dont know what is happening

Pls check case status with your eac # for both I-140 and I-485, if it is opened, they will post it in both cases. That will give you some relief.
