Let me join this forum and share my experience.
My I-140 of EB2 NIW was just dineid and filed MTR.
When something happen, I will post here shortly.

I-140 message change

Guys,

My I-140 (filed on a substituted labor), denied on basis of education and inability to pay in april 2003 and case transferred to AAO in sep 2003.

The status for 140 and 290B were same...

"On September 4, 2003, this case was transferred to our Administrative Appeals Office for review. That office will notify you of any further action taken on this case"

Now, the I-140 status is changed to

"On September 12, 2003, your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received here for processing. It is taking between 30 and 60 days for us to process this kind of case. We will mail you a decision as soon as processing is complete."

What does this new status means? any ideas?? :confused:

Hopefully, your I-140 reopened and will approve soon. Do you see any LUD / status change on 485? If so, definitely your case will successfully reopen and will approve soon. Good luck.

It's kind of lengthy process. Your case went to AAO, so AAO will take a decision.Nowadays, it's taking about a year.Mine is pending with AAO since Aug'04.

What if LUD changed on I-140 after I290B receipt

Unitednations & other experts,

My case(EB3-India-PD-07-21-2001) got denied because of 'A2P' issue.

I140 and I290B got the following messages sequentially and 2 LUDs thereafter and stopped.
Can we infer something from the LUDs or it is common to have some LUDs after they reached commissioner's office?

First message for both I-140 & I290B:

On February 10, 2005, this case was transferred to our Administrative Appeals
Office for review. That office will notify you of any further action taken on
this case

Second message:
My I -140 status changed to the following:
On February 22, 2005, your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received here for processing. It is taking between 30 and 60 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.
while my I-290B status changed as the following:
On February 22, 2005, your I290B NOTICE OF APPEAL TO THE COMMISSIONER was received here for processing. It is taking between 30 and 180 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

But presently for EB3 cases, the appeal is taking about 14 months. The timelines shown in the messages are optimistic. But it could be misleading as the adjudicator used common template without bothering to change the timelines to the actual dates?

Coming to my problem. I am part of the 4 guys from CSC who got blanket denial due to a2p. We MTR/appealed with your great help. But unfortunately, they have not opened our cases on BCIS motion, instead sent them to AAO, shattering our hopes.

Recently a memo was issued which rescinds the earlier memo for 'Zero tolerance'. Are there any chances that we can see some change in Service centres' attitudes on denials and reconsidering already denied cases etc?

I am planning to take a backup plan like re-applying I-140 etc.. I will update the forum when I take the steps in that direction.

Yes, 485 LUD for my wife and me changed. We did FP in dec '04 but no status update for that :( :( .

Rescension of straight denials

Hello All,
Has anyone had a straight denial and based on the rescension of the memo that allowed the above , talked to your lawyer about approaching uscis for reconsideration if so please post your details.

I got my receipt after 25 days. No update yet where the case is now.

I don't know what is happening on my cases.

It is already been 2 months old after series of LUD changes on my MOTIC and denied I140 cases. There is no message or any letter of communication. I dont know what is happening. You told me that as my case is a MOTIC it may not sent to AAO. So could you please shed some light on it. Do u want to me do another case status referral? I did one in Dec'04 and they replied with message saying it may take more time
