Appeal - MTR/MTO ?

Unitednations,

My employer recently received a notice of action for my I140 appeal, it says

after the review, CIS is treating my appeal application has motion to reopen /reconsider.

What does this mean ? My attorney applied only to appeal the decision but CIS is considering the appeal as MTR/MTO.

Is this a good sign?

This is the exact message on my notice

After a review we have decided to treat the appeal filed in the above case as a Service Motion to reopen or Service Motion to reconsider. You will receive a notice under separate cover once all action has been completed.

I140 case status message:

Application Type: I140, IMMIGRANT PETITION FOR ALIEN WORKER

Current Status:

On December 22, 2004, we received your response to our request for evidence or information. It is taking between 150 and 180 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.


I290B - Status

Your I290B NOTICE OF APPEAL TO THE COMMISSIONER was received on November 4, 2004. We mailed you a receipt with information about processing. It is taking between 30 and 180 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

EB3 AAU Latest NSC processing date

Hi,

Any recent EB3 case processed details with AAU, so we can estimate how long we have to wait for the pending cases.
Recently we saw some EB2 processed details with AAU, but no single EB3 case.

How many days to Deny.

Hi All,

I have a education RFE on my i140 and we have filed a response pleading the case. Response was received by BCIS on Jan'26'2005.

Have 02 questions please,

1. How long(avg-days) before a decision/denial is made.

2. If denied on what basis can a 290B be filed and what difference is it from the Appeal to AAO.

Please advice.

What is the phone number for LUD check.

since uscis web-site doesn't update for denials, you have to watch for LUD changes on the 140/485. If the LUD changes for both on the same day without a message change then it is bad news.

LUD changes stopped on my cases..

for MOTIC on 1/19/04
for I140 on 1/21/04

If some decision is taken on MOTIC why the LUD on I140 after 1/19/05

No message updates or my attorney havn't recd any communication. I dont know what is happening.
 
MTR status

Hi Unitednations,
This is my first post in this Forum. I got I140 denial notice b'cause of company's ability to pay and my lawyer has submitted MTR. On Jan'26th, online status has changed to the following text

On January 26, 2005, this case was reopened on a BCIS motion, and the case is now in process. It is taking between 90 and 485 days for us to process this kind of case. We will mail you a decision as soon as processing is complete

How should I interrpret this message and how long would it take for USCIS to take a decission on my MTR.

Confusing LUD

Oh boy ! This is EB3 Educational Equi ... case, initially LUD on I-140 was

"On June 23, 2003, your case has transferred to AAO. It takes blah...."

and on Jan 26' ' 05 it changed to

"On August 1, 2003, your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received here for processing. It is taking between 30 and 60 days for us to process this kind of case. We will mail you a decision as soon as processing is complete."

Why they updating LUD now when something has changes on Aut 1, 03. Relly confusing. any ideas ?
 
As per the duration after 60 day's you can contact the USCIS. Try to call them to initiate further move on your case.

Receipt for Appeal

Hi Folks:

Just wanted to cross check what my company is saying:

My I-140 (EB3 - VSC) denied based on Education Issues. My company has filed appeal with INS. Now when I asking my company whether they received the receipt, they said, 'we will not be receiving a receipt for the appeal, we will be getting a final decision from INS'.

Is this true? My understanding is that we do get receipt for appeal.

Yes, you (your lawyer) do get a receipt for MTR and it has it's own EAC #.
 
Friends,
My MOTIC (Company's ability) was filed on Oct 6th. There were couple of LUD's between 01/17 and 01/21...but nothings happened after that. The case was neither approved nor has been sent to the DC office..any ideas?

I am in the same situation. MOTIC (ability to pay denial for I140) applied on 07/21 then LUD changes on 1/19 for MOTIC, 1/21 on I140 but no updates on messages or no communication
