Track EB2 cases Current in May 2006 Visa Bulletin.

Can any one answer please...

My 485 RD is 09/28/05... i am on EAD now.... My I140 us approved too...
just waiting for visa numbers... but unfortunately EB2 stopped moving...

My employer is is crazy....so i want to move out of it...

Can any one tell me whether i can safely move with AC21 rule...because i completed 6 months by March 28 from my I485 RD.....

Hello Maveric,

Yes. You can user AC21 rule to switch the employer (sponsor employer), If your I-485 is pending more than 180 days and I-140 has been approved.

But make sure that job and responsibilities in your new job shoud be same as stated in your labor/I-140 application. Do you have labor certification copy with you. If so, try to get the new job offer letter reflect the job title/role/responsibilities/salary matches with your approved labor certificate.

If you do this, your portability will be safe.

AC21 does not have geographic limitations. The new job can be anywhere within the United States.

Inform to USCIS immediately about your job change, after you joininig with new employer.

Security Check pending..

I have visited this forum several times in past 2 years while waiting patiently for I-485 approval (spouse and myself). As a matter of fact we are still waiting for approval. Our priority date got current on May 1st but looks like the "name-check" curse is still holding things back.

I-140 Approved 02/14/05
FP (Code 1) 03/19/05: Results sent to USCIS next day
Congressman Enquiry 10/10/05 - Name check pending
Senator Enquiry 11/10/05 - Name Check pending
FP (Code-3) 03/01/06
3 APs, 3 EADs, 3 Premium processed H1Bs, Finally got 3 year H1B extension
I485 - Wait continues...
 
Did anybody from this forum get their Namecheck cleared, since becoming current in May 2006?

GC approved on 11/13/2006, for self and family. Got the emails yesterday morning notifying me of the approvals.

I updated the list....tooo....looks like all 2004 - 485 filers are out of the list...
only me/TXLCRIR/q4u/cksrp from 2005 still waiting...

How was your namecheck experience?

Actually, back in May when the PD was current, I had called TSC. I was informed then, name check pending. After that I did not trouble TSC. I had heard of all possible scenarios with name check, but just decided to keep away from all, thus keeping my BP and frustrations to a minimum.
 
Cards Received

All, I received my cards in the mail today 11/18/2006, for self and wife. Since my son's biometrics were not done the first time (< 18 yrs), I need to take an appointment with an ASC for his biometrics, after which his card would be issued. Other than this small hickup, our application to adjust to permanent resident status stands approved.
