Tourist to Student Visa.

My friend has entered the U.S. from the United Kingdom as a tourist. She was given an allowed three-month stay. She now wants to extend the stay for another 3 months? What are the issues? What if she wants to change her stay to that of a student?

Please advise as time is running........

If she used VWP - no.

If one stated upon entry on B2 that she was visiting schools, F1 COS might be granted. If not, it is far less likely and COS to F1 takes more time than F1 stamping.

I think she is trying to stay fraudulently and has no intention of studying.

If she came to the US visa-free, neither can she extend her trip while she remains in North America, nor adjust status to a student visa. She must go back to the UK and apply for a visa from there.

In addition, someone who entered on a Visa Waiver can be summarily ejected for overstaying under DHS authority carried out by ICE, there is no right to go before an Immigration judge or appeal such an administrative removal order AND that person can never use the visa waiver program again forever. They MUST apply even for a tourist visa and MUST make a darn good case.

She can TRY to leave soon and then come back, get a new I94 and HOPE for another 3 months. Some people get it, some get less time, and some aren't even allowed in.
