To WantmyGCnow.... RFE - please reply

I have just received a RFE asking for all my original national passports (valid & expired), all RTDs (Valid & Expired), exact dates when I visited any countries since I was granted asylum, origional I-94s and proof of atleast one year physical presence in USA at the time of filing my I485 etc.

They said that service records show that I have travelled out of country since I was granted asylum/issued travel documents.

I do not have my very first RTD (expired in dec 2000) with me but I do have rest of RTDs.... Because of my technical profession - I have travelled out of US a lot & I am not 100% sure if I have travelled for a day or two/couple of days on my very first RTD as well (I am not able to recall if I have lost that expired RTD or returned to INS 5 years ago). What will happen if I miss putting some travel date from that year eventhough my physical presence documents fulfill my one year presence requirement......? do they have transportation passenger records of that time...?

I have collected proofs of atleast one year physical presence before filing my I-485. Proofs include Employment verification letters, Community services letters, W2 forms, tax returns, Social Security Admn letters etc. I did not have any fixed residence during that time, I stayed with whoever gave me shelter so I do not have apartment leases.

What do you think, why did they ask me for all this at this stage....? please advice....

Just send them the evidence that you do have. It is more of a formality than anything else for them to ask about it. But do include an explanation letter if you are missing anything e.g. your first RTD etc

Singh, Lazer is correct. Whatever you have submit.If you dont' have a I-94, explain that you surrendered it. Type up a letter with all your travels sorted by Year such as

2000

18 Sep-20 Sep - Travel to Mars,

Evidence: COpy of airline ticket(exhibit A), Copy of I-94 attached as reference(exhibit b). Copy of RTD attached (Exhibit c)

2001

Dec 25 - To north pole, USA,

Evidence:....blah blah blah

Wantmygcnow, congrats on your GC! Are you serious?? They will want to see copies of tickets?? Don't they have other more important things to do? I have travelled three times, last one was in 2003, I definitely don't have copies of tickets, and RTDs were sent back when exchanging for a new RTD. I only have one I-94 that says 'Asylum granted'.

Well I had most of the stuff because I had the habit of making copies of everything..I guess I was paranoid...They ask for it..so maybe they need it?

I was really upset that why did they ask me for all this... and what will happen because I do not have everything they are lookin' for..... U know ....u can understand this pain because we all are in the same boat.....it took almost six while waiting for this GC.....and now instead of seeing my GC ... I got this new RFE...... Thanks again!!

Singh6, I hear you! I have been waiting for this piece of plastic since 1997!!! If I get a similar request from USCIS, I will send them nothing, may be this year current RTD and tell them this is all I got. Legally they cannot deny your application just because of you dont have copies of tickets, NPs, RTDs - I double checked with a friend who is an immigration officer.

14ksusha...all what they ask for is a requirement. You need to submit something if asked..if you ignore..your friend wont be able to help you if your application gets denied...Here is what an asylee needs to get his GC approval:..I am sure the officers go through each and check mark to make sure they have it..as a formality..by law:


Gaining LPR Status as an Asylee

Form I-485, Application to Register Permanent Residence or Adjust Status, is used to adjust the status of asylees to that of a permanent resident. Applicants must have been physically present in the United States in asylee status for at least a total of one year prior to filing the Form I-485.

The asylee should file a Form I-485 with the following supporting documentation (in this order):

* Fingerprint fee (this fee applies to applicants who are from 14 years of age or older)

* I-485 filing fee

* G-28, if applicable, signed by the attorney (or authorized representative) and the applicant. Facsimile signature stamps are acceptable for the signature of the representatives. However, applicants must sign the Form G-28 submitted with the application in the original.

* I-485, signed. Box "d" of Part 2 of the application should be marked. If the applicant is an Iraqi who processed through Guam, also write "IRAQI/GUAM" in the margin.

* 2 photos in an envelope stapled to lower left corner. The name of the applicant and A-number, if known, should be lightly written in pencil on the back of each photo. Details on photo size, etc, may be found in the form instructions.

* G-325A, signed, (if the applicant is 14 years of age or older).

* Evidence of Asylee Status. Evidence might include a copy of Form I-94 and a clear, readable copy of the letter granting asylum. If alien was initially given conditional asylum, submit evidence to show that the conditions have been removed. See Resistance to Coercive Population Control (CPC) Programs for more information.

* I-602, Application by Refugee for Waiver on Grounds of Excludability, if applicable

* Evidence of one year’s physical presence in the United States. Please keep physical presence evidence to an absolute minimum. Evidence might include a letter of employment, a lease, school enrollment records, or similar documentation, which would cover broad periods of time.

* Proof of any absences from the U.S. since you have been granted asylum. For example: photocopies of pages in refugee travel document or passport.

* Birth Certificate or other birth record

* Proof of any legal name change you have obtained since you were granted asylum status

* I-693 Medical with Vaccination Supplement. Only a civil surgeon designated by CIS to conduct medical examinations may complete the Form I-693 and the vaccination supplement submitted with it. Call the National Customer Service Center at 1-800-375-5283 to locate civil surgeons (doctors) where you live. (NOTE: The I-693 should not be filed with the initial asylum-based I-485 adjustment application. This information will be requested at the time of adjudication.)
