To do OR not to do AC211?

challenging question : To do OR not to do : changing employer by using AC211?

Here is the situation
1. Got RFE when doing I140
a. Ability to pay
b. Company annual financial gross
2. a. In 2004,2005 have been on bench for total 6-7 months
b. Salary at the time on bench is below the prevailing wages.
3. When doing H1B got RFE because of location change however
did not send the document to notify changes in I140.
4. Just apply I485 on the month of May
5. Have H1B extension which last until end of 2009

Since I got multiple RFE whenever apply,
I assume I will got RFE for out of status in I485.
(I think out of status because on bench)


So, after 6 months, I am planning of changing company.
Now if you guys in my position, will you guys
change company however I am afraid if I change company when I got RFE
asking for documents from the previous company. My previous company
might not want to give the document.

What do you guys think?

did you go out out of US after 2005 and got new I-94? if YES I dont see problem for that "bench/table"

Thanks for thoughtful question. I did not go out of US after 2005. Why is going out of US after 2005 is important in this context?

if you go out and thenget new I-94 when enter then out of status in past does not matter.

wow, thats an excellent advice. Ok. since I have not go out of the country since 2002. What I supposed to do to have less risk.
Recently I have
1. Approved Advanced Parole till next year August
Question 1:
(If I used Advanced Parole, it means I will got out of the country and get a new I-94. Is it?)
Question 2:
If I used Advanced Parole, it means my I-94 will be valid for 1 year since it is stamp for 1 year. (Eventhough, I have H1B until 2010).
Now, once I used Advanced Parole, I can switch employer once I arrived in US. Is it true?

2. Approved AED till next year August
3. Approved H1B till 2010
