TN1 to H4

I am on TN1 and my wife on H1B.

I might loose my job and would like to move to H4.

Do I need to go to POE or can I get a immigration attorney here in US to help me out with the change of status ?

You vcan either go to POE (with copy of spouse's H1, copy of their recent paystub, to prove they are still in status, and your marriage certificate). You would need to do this in short order.

You can alternatively file an I-539 the day your are laid-off, and include a copy of same docs, plus your I-94 for TN)). I wouldn't waste money on a lawyer for this. The I-539 is the simplest of forms. This will take several months for approval, so most simply end up getting a border H4 eventually.

Thanks.

I found from attorney and it costs USD820 for the change in status process. Will go to the POE instead.

Question: How soon can I get transferred on H4 after exiting US. My job gets over on Friday and I am planning to apply for H4 on Sunday. Is it okay or is the time too short.

What do you mean "time too short"? You NEED to change as quickly as possible. Delaying is not an option. The border agent isn't waitying for anything. You show up, with your spouse's H1 and you get h4.

The filing fee for an I-539 is $300. You may want to (unless you live an hour away from the border) mail it today, requesting a change of status effective Saturday.

Indeed, you should not need a lawyer to file I-539, so the cost analysis in your mind should be $300 (not $800) vs. going to border.
