TN Visa with a pending I-140?

Hello all,

My wife is filing form I-140 for her EB-2 application. I'm going to work in the US next year on a TN visa. We're just wondering that if she states I will apply for adjustment of status as a beneficiary on her I-140 form, would that result in my TN visa being denied?

Thanks for your help.

No. Until you actually file your I-485, you remain eligible for TN. But it is not necessary to answer yes to that question about you in any event.

Thanks so much Nelsona! That's very reassuring to know.

Just to confirm, even if I select "No" for that question in form I-140, I can still file my I-485 in the future?

Thanks again!

Hi all,
I am currently employed in Canada and have an opportunity to transfer to our US branch on a L1A. My wife and I are both Canadian citizens. Since my wife would also like to continue working in the US and given the very long processing times for L2 EAD , we are looking for guidance on which route to take.

Kindly suggest if these options are possible and which if them is better.

-L1A for me TN for my wife. Once I get GC, convert wife’s TN to GC ?

-L1 for me , L2 for my wife.
She applies L2EAD.
While waiting for L2EAD, she works on TN. Once L2EAD is approved, converts TN to L2EAD
