TN visa renewal email approval received, Can I travel outside the US before receiving i-797

I originally applied for my current TN visa at a U.S. port of entry approximately three years ago. As a result, I do not have an I-797 associated with this visa, since border-issued TNs do not involve USCIS or the issuance of a formal I-797. My current TN status is valid until July of this year.

Recently, my employer submitted a TN renewal petition to USCIS using the premium processing service. I just received the new approval notice through email.

I am planning a short trip to Canada this weekend, which will be prior to the expiration of my current TN visa in July. I wanted to confirm whether I can exit and re-enter the United States during this time, if I don't have the renewal i-797 (I don't even have a scanned copy of it, my lawyer hasn't received it yet).

Specifically, I’m wondering if re-entry under my current, valid TN status would be permitted.

Yes, you can enter on EITHER your existing TN (you should have your I-94 from that approval or a more recent one), OR you can ask them to look up your renewal petition in their system (have the petition number ready), and have them process a new I-94 for you right there, with the new extended date (assuming your passport is valid for the full period) or to the expiry date of your passport.

But, without a doubt you can enter on your current TN.

Thank you so much!
