TN Visa Refusal

Hi,

Please, I need help and advice. I am a Canadian Citizen and got a job offer in the USA as a Financial Planning Analyst. I went to the USA Port of Entry at the US-Canada border to apply for a TN Status, but unfortunately. I was refused, stating that my job title did not match the list of qualified lists of occupations. My passport was not stamped; the immigration officer only verbally stated it to me and entered some information in their system and advised to speak to my employer to apply for the H1-B Visa for me.

I went back to look at the list of occupations, and the closest is an Accountant. My employer is willing to edit my job offer to a Financial Accountant job title and description. That way if I can go back and apply for the TN Visa instead of the H1-B Visa.

Please, what steps can I take? I would need any help or advise I can give.

Are you a licensed accountant? If not, you are not eligible for that TN. Besides, if you were really applying for accountant job, they would have said that from the beginning. CBP will see through this charade.

The officer was correct: you might be eligible for H1-Bm but not for TN.
 
Ditto to Nelson. It seems likely you would anger the port officer if your job offer from the same employer magically changes job category.

I was in similar situation couple of month ago, The TN was refused because the job title/description did not match the category, my employer change the title/description to match the category. What i did was i did not go back too soon. Stay a week or two and go reapply. Make sure eveything tally before you visit again.

There is a difference between having a job description that does not match the category one requested, with requesting a category that one is not qualified for.

Your idea of waiting a week or so is not a bad one. It makes it look like they re-evaluated your job (which would take some time) rather than just simply edited your letter to conform.

Gotcha, I assumed he was qualified to be an accountant.

If you do not qualify @mama800 as accountant it will not be advisable. The expert opinion is required in your case.
