TN - Visa Advice

Hi Folks,

I am a Canadian Citizen originally from India. I have a 3 years diploma in Electronics from India equivalent to Post Secondary Certificate (assessed by IQAS). For the last 10 years I have been working as Oracle DBA out of which for 5 years I have worked as an Independent Contractor in Canada. These days due to the market situation I am unable to find work in Canada. I am thus looking to get a job in the US. On the basis of my qualifications, I believe I should be able qualify for a TN-Visa under the Computer Systems Analyst. Is my analysis correct? My question is how am I supposed to show my experience to the officer at the border. Is it sufficient to just take a resume with me or do I need to take experience letter from my employers to show that I have over 3 years of experience. Also should my resume or experience letter show that I have been working as Oracle DBA or show the responsibilities of Computer Systems Analyst.

Any advise is highly appreciated.

You are ineligible for TN under CSA category because you don't have a bach degree and your diploma is not from N America. Your only alternatives are a position which meets management consultant TN (which does not require degree), or find a position where the employer will be willing to apply next spring for an October 2015 H1, since H1 permits equivalency for missing years of study.

Yes, I was looking for second opinion. I am unable to understand why the US govt would give TN-Visa to Diploma holders from Canada,US and Mexico only and not from other countries while for Degree holders they do not have such criteria and recognize them from any country. Don't you think this is an anomaly in the rules?

I agree, it's an anomaly. Perhaps they should have also negociated to disqualify bach degrees from non-NAFTA countries. But that was not what was negociated. It is not the US govt deciding this. It applies across NAFTA region. Them's the rules.

Feel better? Probabaly not.

By the way, a bachelor's degree would have to be equivalenced if it was not from N America.

I won't give you any more information, since you will merely ignore and ask elsewhere.... your definition of "persistence", I guess.
