TN Transfer and Start Date

Hi. I need your help and guidance. I appreciate your help in advance. I was laid off from my company (Company A) on May 22, 2024. My grace period ends on July 21, 2024, and my I-94 is valid until October 2026. I am a Canadian on a TN visa currently in the US. I have received a new job offer from Company B. I would like to start the new job on August 1, 2024. My question is:

1. Is it possible for me to ask Company B to start the new job on August 1, 2024, and then drive to the border with that offer and the necessary documents to get a new TN visa on July 1, 2024? Or will the border officials consider this too early?

2. Is there a difference in the process between transferring the TN or getting a new TN? If the answer to the 1st question is "too early", can I exit US on July 1st (within the grace period) and fly back in the US with the documentation on August 1st?

3. Which option would you recommend?

Thank you so much!

1. It is very likely that a border officer would give you a TN on July 21 (which is your last legal day) for a TN that starts in August. Much before that is questionable.
2. There is no such thing as a TN transfer. You are getting a new TN each time your change sponsor. You can certainly leave for Canada anytime you wish and get a TN in mid to late July. That is essentially the same as what you are planning above, except by plane instead of car.

3. Either. Or you could ask the new employer to file an I-129 for you in early July (Premium Processing) and not have to leave US at all.
