TN to H1 with 2 employers, possible??

I'm currently on a TN valid thru 2/12 with Employer A. Employer B wants to hire me on a H1 starting October 1st 2010. Can I continue working for Employer A on a TN until October 1st (provided my H1 is accepted) and then start work for Employer B on October 1st (of course, leaving my job with Employer A).

Will immigration notify Employer A I'm being sponsored for a H1 by another employer?? (which would not be good, as I'd like continue employement on good terms with Employer A til September, at which point, I'd give my notice).

Thanks in advance to anyone who can provide insight on my case!

Your initial statement is correct. You can work at TN job until 9/30/2011, at which point you must stop and begin working for the H1 employer. No notification will be made to the TN employer at any time before or after 10/1/2011.

If employer B had sponsored TN for you, you could have kept working at both places.

Thank you!

Thank you so much for a quick reply! I dont want to work at both jobs anyway. I just wanted to make sure that Employer A would not be notified of my "plans" and not have to worry about that.

The thing is I'm still unsure if I want to work for Employer A or B. So I want to take the 6 months to come to figure it out.

Wow an employer who wants to wait til' Oct! Most employers I deal with, would want you to start working for them ASAP, that's why they prefer TN, no matter what they do after (H1 or GC).

It would be much better for all concerned if you began working in TN right away, and then had a chance to decide. There is no need to wait for h1. You might want to remind employer of this. You could even work as contractor under TN for a bit to find out if there is a fit.

True

I see what you're saying, but Employer B is opening a new branch of its current company and they really only need new employees starting in July and as I've worked for them before in Canada, they know me well and have no problem waiting for me to start work on Oct. 1st.

Thanks again for your replies and your time. This site is really awesome.

Oh, and I couldnt work for both, because geographically, that wouldnt work. 2 different states!
