Hi everybody,

I am in the process of applying for I-485 and I have a bunch of questions. The priority dates are current in my case.Here are the questions;

1) I have read in one of the threads that nelsona mentioned about the 45 days rule of waiting period for tn holders. Could someone please share their experience on the waiting period experiences? I am afraid that the priority dates may retrogress in coming months and I just want to get this paper work in time.

2) About applying for EAD and AP questions. Is EAD employer specific and job specific? Will my action on applying for EAD and AP with I-485 will cancel my tn? Or should I just wait it out for few more months before I apply for EAD so it will extend into the work period in the future when tn expires?

-- No. Your existing TN will be fine, but you will not be able to get another TN.

Nor will you be able to enter US on that TN. So you need to stay in US until you get both AP and EAD, and you need to get these before your TN expires.

:) what about that 45 days you mentioned? nelsona, You know how the priority dates retrogress and it can change in a memo. I was hoping to get it done as soon as possible but I hear your concern in the past.
On the EAD,I am hoping to apply for my EAD so it will extend into the future when my tn expires. may be 3 months before tn expires. I'll stay in US when going through this process, nelsona.
 
You should apply for your EAD with your I-485. It is too risky to be on TN while I-485 pending.

As to the 45 day 'rule' it is not hard and fast, but 45 days is minimum between entry on TN and filing for I-485. Sooner than this, you can be considered to have basically lied about your intentions when you entered on TN, invalidating your status and rendering your I-485 application void. Be aware of this.
 
Hi Nelsona,

On the 45 day rule, by TN entry date do you mean the date TN is granted or the last day you entered US, meaning you might have your TN granted in Jan 2008 but left the country and back in March 2008, which one is considered, Jan or March?
