TN Technical Publications Writer - Change Employer

Hi there,

Bit of a tricky case here... would love people's perspective.

Hold a Bachelor of Commerce degree and applied for an Economist TN in 2018 for a Chief of Staff role at a media company, and was asked to withdraw at Pearson POE for not having the right educational credentials (this was at the height off economist scrutiny). Successfully switched to Management Consultant TN going through Calgary POE, however had to be an independent contractor at my company which wasn't ideal.

TN was running out in late 2019, so switched to Technical Publications Writer (wanted to stop being a contractor) by leaning heavily into the writing / communications aspect of my role. Applied successfully at Newark - truthfully, got lucky with the CBP officer as he didn't even look at my application, just asked me how long I needed the TN for and he approved it.

Now, I received a job offer for a business operations role at a new tech company. The role as outlined is very similar to my current role as a Chief of Staff. The lawyers (Fragomen) have recommended that we re-apply under the Technical Publications Writer role via a mail-in application, given that I already hold a TN under the Technical Publications category, so hopefully there will be less scrutiny.

I'm worried that a mail-in application will be scrutinized more than crossing via a POE. I'm currently working remotely in Calgary right now so wanted to cross through YYC again.

Anyone have any thoughts on mail-in vs. border crossing?

I'm also worried that if I get an RFE / denial for Technical Writer, will I be able to apply under a different category like Economist but try through a more relaxed POE?

Appreciate any help!!!
 
I doubt yoy will get a Tech writer TN; you are a management consultant. You can be an employee as an MC, just not long-term, which is fine.

1) Should I still try to change employer via mail-in first and see what the result is before trying another TN category? Given that already have the Tech Writer TN with my current employer?

2) Thoughts on mail in vs. cross the POE in YYC instead?
 
Having a TN in a category that you admit was probably inappropriate doesn't bode well for approval from either USCIS by mail or CBP at PFI.

Take your pick on which you choose. I'd be working on a better petition.

Well, it's not that it was inappropriate - but it was just certainly a stretch...!

I agree with you on working on a different petition under a different category, particularly Economist - but seems like Fragomen really want to try to renew / change to the new employer within my existing category as a first option.

If there is a denial / RFE, will that limit options in terms of changing categories in the future with a new petition?
 
Each petition is handled on its own merit, which is why your previous dubious approval as a Tech writer is no indication of future decisions. Either way, you will have your answer in a short time (assuming your premium the I-129).
