Background:
- I currently am on TN Status I got at the Montreal airport. It was my third TN and I was absolutely grilled by CBP on this one. This TN is good until March 2025.
- I am getting married in the fall and plan to apply for a marriage based green card.
Issue:
- I realize there is no direct path from TN to green card.
- The processing time on the green card may exceed beyond the expiry of the TN in March 25 therefore I think it may be best to secure a TN renewal before applying for the marriage based green card.
Questions:
1) I believe if I apply for the marriage based green card in the fall (and it doesn't come thru by March 2025) that will screw up a TN renewal in March 2025 (ie. I will have already applied for perm immigration status and this application in progress means I will be ineligible for a new TN). Is this a correct assumption?
2) I think the safest path is to secure the TN extension first. If I try to do this at the border prior to March 2025 I will likely be turned away by CBP and they will tell me to come back and apply close to the expiry in March 2025. I think the best route is to apply for an I-129 extension 6 months out from March 2025 and once the extension is secured apply for the green card. Is this assumption correct?
