My TN along with my family's TD is expiring on Sep 23rd and I obviously need to apply for a new TN inorder to maintainy my current status. However, my 3 years old daughter's passport is in Canada at the moment for renewal and it might take passport Canada around mid of October before they mail it back. Just wondering if I can apply for the new visa at the border one month after my current visa expiry? Would it create any complication? Should I rather go alone to the border to get my TN renewed and later get the renewal for my family? Any pointer would be appreciated.

Why not just mail in for your TN? You don't need a passport to get a TN either by the land border or by mail in I don't believe. You can't work on your current TN if it expires, so applying a month after it expires leaves you in the US without a job and possibly illegal pressence (think it's 10 days you can stay if you don't have a B visitors visa)...

Exactly. Mail in an I-129 for yourself with a copy of your degree and any other documents you needed for your original TN, and an I-539 for your dependents. You don't need a passport for a mail-in.

So, BEFORE sept 23, you need to either all go to the border to get new TN/TDs, or file I-129 for TN and I-539 fopr all dependants.
The fact that they will not be approved by novemebr is not an issue, you will then ALSO need to get a TN at the border at that time (if you mail in).
You MUST get legal status fore the period after Sept 23, and this is done by a trip to the border or mailing in I-129/I-539 before sept 23.

However, Canadian citizens traveling to the United States from outside the Western Hemisphere are required to present a valid passport at the port-of-entry;
Canadian citizen spouses and children do not need visas, but they must have the following documents at the port of entry:
Proof of Canadian citizenship;
Proof of relationship to the principal applicant, such as marriage certificate and birth certificate; and
Photocopies of entry documents of the principal applicant.

The thing about needing a passport was if you were going to fly. I'm assuming you are still going to do that.

What he is telling you are the only options. Either drive to the border and take care of it there or do the mail in thing and pay the extra fees.

sabih, I don't know what information you were looking for, but what you found has little bearing on your case: you need to do *something* for all your family members by the 23rd, or you and/or dependants will be out of status.
Either submit the required I-129/I-539s by that date, or go to the border for TN/TD.
The same rules for TD that applied for your daughter last year are in effect now.

When you originally came to the US all you had to show for the TD was to show the relationship between you daughter and you (including one between your wife and you). Generally they are looking for a birth certificate naming the parents and a marriage certificate. Just having a passport is not always good enough. In your case you may have come through with just the passports as the relationship. If so, then you got lucky. We have always had to show our marriage certificate to get a renewal and birth certificates of the kids.
