TN layoff problems: status and EI

I had a 3-year TN but unfortunately I was laid off last friday. My last work day is Feb 27. I am looking for new jobs. I have some questions about my status and EI:
(1) I searched this forum I know I have to fill I-539 to extend my stay in US. But when is the best time? my last day is Feb 27.
(2) I have worked 2 years in US for the same company.
Can I apply EI in US and how? but, you know I am canadian I was on TN.
(3) Can I apply EI in Canada. how? but I didn't work in Canada.

Does somebody have similar experience?

After reading the link you gave to me, I understand I have to be in Canada to apply EI. I am thinking I can't apply Canadian EI while I am in US. The problem is I may stay in US for a while to look for new jobs. Suppose I have spent 2 months in US and I didn't get a new job; then I go back to canada. Because 2 months passed, am I still eligible to apply EI in canada? is there any time limitation to apply EI? Thank you!
 
Remember, I said, that once you contact Canadian EI they will advise you on how to proceed. In most cases you will be collecting UI from that state, paid to you in canada. Both Canada and each state have certain time limits on when you can apply for UI/EI.

So you need to talk to Service Canada, and then proceed.

Basically you have to weigh your odds of gettin ga new job in US vs collecting EI in canada.

Do you feel lucky? Stay in US and look for work.

I went thru this scenario in Feb 2008....though my endgame was different.

I never contacted service canada...I did not intend to return to canada, but from my understanding, which I am on the same page with Nelsona, you have to gauge your chances of getting a job in US, before you start unravelling your affairs to relocate back to Canada.

You will NOT get Canadian EI while residing in US...unless you have permission to "live & work" a.k.a green-card...so here are the most immediate steps-:

1.) file I-539 to switch to B2 (for all TN/TD in your household)
2.) include a cover letter to "explain" why u need a B2 i.e. need time to wrap up your affairs such as selling a property, finalizing school year, impending surgery...whatever...(this buys you time to interview and get another job)
3.) if within 6 months of filing for B2 (or your savings are running out) you dont have a job yet, scoot off to canada

Now, I am not sure if you rush to Canada now to file, you are allowed to collect while you are "outside of Canada" wrapping up your affairs...that my friend, is the million dollar question, which I never explored.

All but a couple of states have an agreement with canada, such that the STATE pays UI. t is rare that Canada actually pays EI to someone that has worked in US. That is what the agrrements are about. Canada EI only acts as a go-between.

So, the major eligibility issue is with the state. The question becomes if you wait 3-6 months to file your cliam, will the state, not canada accept your claim, and will canada accept to support your clim with teh state.
 
I had a similar situation in the 90's. I had to fill out some paperwork for the US State in which I worked to try and collect unemployment benefits in Canada. It took long enough that I never got anything before landing a new job in Canada - a month or two, as I recall.
