TN holder about to marry USC

Hi. I am planning to marry a USC. My fiance will file AOS and EAD after we are married. My questions is, while I am pending status on my AOS---can I still work for my current TN employer? As I understand it, my TN is nullified if I apply for AOS. Does this mean that I have to wait until I get my EAD approved before I can work again??? Being unemployed for months is a scary thought....

Any advice would be great.

Your TN is not nullified. However you cannot renew it, nor can you enter the country on it. This includes wedding/honeymoon in US.

So once you marry you MUST stay in US until you get your AP/EAD and you must have sufficient time (3 months) on your current TN to continue working without interuption until EAD arrives.

Question for nelsona and others

thanks nelsona,

another question for you: while my AOS is being processed, what can I do if I get another job offer from another company...can I accept the new offer since I am not allowed to cross the border and get a new TN? Or do I have to stay with the same company until my EAD arrives?

thanks

You won't be able to get a new TN by mail. You had better not go to the border either, since without AP, you will not get a new TN, you will not be allowed to re-enter AND your I-485 petition will be considered abandonned.

You would then need to apply for a 'k' visa from outside US, and wait there for its approval, and still not be allowed to work immediately afterwards.

Wait for EAD.
