TN from India

I am planning to move to India for one year. Couple of questions?

1) If I decide to come back to US, Can I get a TN at US POE while flying from India? Do I need to go to Canada and get a TN from Canada to USA?

2) Do I need to go back to Canada if TN gets rejected at US POE? The assumption here is I'll be flying from India to US.
 
Any Canadian or Mexican citizen can apply at an international airport POE or pre-insprction abroad, it is not restricted to land borders, (the Mexican citizen requires a visit to a Consulate first).

If you are a Canadian citizen, then you are not required to apply for a visa with a U.S. consulate or file a petition with U.S. Citizenship and Immigration Services (USCIS). You can request admission as a TN nonimmigrant at a U.S. port of entry, and you must provide the following documentation:

Proof of Canadian citizenship

Letter from your prospective employer detailing items such as the professional capacity in which you will work in the United States, the purpose of your employment, your length of stay, your educational qualifications

Credentials evaluation (if applicable)

If you are eligible following inspection by a U.S. Customs and Border Protection (CBP) Officer, then you will be admitted as a TN nonimmigrant. Form I-94, Arrival/ Departure Record, will be evidence of your admission.
 
Thanks. That's good news. I can fly from a country other than Canada and get a TN in US. I thought I need to reside in Canada and get a TN from Canada - US border.
