TN Chances - 'Engineer' related degree Industrial Engineering

Trick

I have a job offer which matches closest to the TN category of Engineer and more specifically Industrial Engineer.

My academic background is in Electrical engineering. I am also licensed as a P.Eng in my province am allowed to perform Industrial engineering work under the license (but the license itself is generic does not name fields)

My company's lawyer advised me this may be a cause for rejection and filed to USCIS under premium processing on the basis of my P.Eng license. I also provided a letter highlighting courses from my Electrical engineering undergrad that matched the job duties.

Now looking into it, I feel like the lawyer didn't research properly because the OOH says this about how to become an Industrial engineer
"Industrial engineers need a bachelor’s degree, typically in industrial engineering. However, many industrial engineers have degrees in mechanical engineering, electrical engineering, manufacturing engineering, industrial engineering technology, or general engineering."

Am I just paranoid on my chances of rejection? Is USCIS have a better shot of success then POE?
Any guidance is appreciated.

Your petition should pass. But anytime you get a lawyer involved for TN, you are going to get over-complicated maneuvers. You are an degreed engineer doing engineering work. Plain and simple. Your firm wasted a couple of grand for nothing.
Btw, you were "allowed" to do all sorts of engineering work without your PE.

I know they did. It is a big company with big pockets who have hired a big law firm. The moment i heard the approach they wanted to take, I immediately figured it out. Unfortunately, the lawyers over-complicated response took me by surprise and I hadn't done my research until now.

Also, this big law firm has not shared the actual petition with me - I am assuming because technically they are filing on behalf of the employer for me. I am going to wait until next week but if the response from USCIS is anything but an approval, I will need to have a tough conversation with a bunch of people.

Folks like this give a bad name to the law profession!

Nelsona, just found the petition was approved. Thank you again for your honest advice. As I am sure others can attest, this is a stressful time for everybody and your work here is really appreciated!
