TN/B2 move to US from Canada

Hi
I am visiting US with my family. My wife is a student, canadian permanent resident with Indian passport with B2 visa and myself and our newborn are canadians. I am currently looking at employment at US on TN visa. I am cosnsidering some options and need sone advice to choose the best option.

a. Go to US on B2, get a job, apply for TN/TD from with in US
b. Go to US on B2, get a job, book an appointment in US consulate in Canada and apply for TN/TD for myself and family and move.
c. Go to US on B2, Get a Job, leave US and reenter to get TN at border. In this case can my wife and kid stay with me for few months (what is the max time allowed?) on B2 and get the TD visa later either by applying by email or by visiting the US consulate in Canada.
d. Go to US on B2, Get a job, leave US with Family, Get the TN and border and start working, Wife and Kid stay in Canada and apply for TD at the consulate and join later.

looking forward to understand the pros and cons of the above options.

Do you not understand how bad the job market is in the US? Why would you leave a job to stay for the extended period in the US with the hope that you might get a job? Many skilled workers have been unemployed in their area for several years; this is especially true if you expect to have a well paying job based on years of experience. If you have skills needed in the US, you should be able to get interviews scheduled and travel alone for them. Once you have an offer in hand, you can return to the US with your family.

Did you read his post? He's already in the US. Let's focus on the logistics of the specific situation.

Hi Concerned4us, thanks for posting your comments. Given my case, I have to take that risk irrespective of the job market. Anyway IT jobs are on the rise and I am confident that I should be able to secure a job in few months. All I am concerned is the logistics related to the Visa''s.

The only concern about your spouse staying on B2 is proof of foreign residence. If you give up home in Canada (tehre is no need to maintain Cdn residence on TN; nor is there a need to have home in canada for Cdn PR status), she risks being denied entry on B2, and would then need to make appt ofr Consular TD, perhaps when very inconvenient for you/her/baby.

The best would -- while all of you are in same country -- you go to border for TN and she make appt for TD at a consulate. Then, when her appt comes, she goes and gets TD. You will already have TN, so her TD will be undeniable.
 
Thanks Nelsona. We are not giving up home in Canada. I am just going to lock it for few months or let my friend rent it. Technically we will be maintaining our residence as my wife has to return back after a year to finish our her masters.
First we want to be in US to visit our family. When we are in US on B2, I can try to get the job and go to the border for the TN and at the same time book the appt at the consulate and after a month or so depending on the appointment availability, we all can fly back to canada and get the TD for my wife and Kid. Does it soound ok? or is there any complications in this approach.
 
"Technically" may not be sufficent for the border to allow future entries on B2, that is all I'm saying. Besides, renting it out does not make it your residence anymore. Since your intention is to soon get TD for her, the issue of home will go away.

It was merely a warning since many think that just because they have a 10-year B2 visa many foreign spouses of Tns try to just enter on B2 rather than get TD, believing that they can enter on B2 regardless of their living arrangements. They can't unless must maintain foreign residence, while TD's do not have to.
 
I think you are overly optimistic about the timeframe unless you have very specific credentials. You do not want just any job, you need to find the "right" job. There are many consulting firms that do not treat their employees in accordance with US labor laws. Many company's now will not even consider someone not currently employed. Your best chance of finding a job is when you already have a job.

"Go" does not indicate that he is planning to act based on his current status in the US but a planned action. If he intended to do something based on his current status he should have used "remain".
