Time for POE

Hi everyone...

we got our immigrant visas last july expires dec 2007. The date is getting closer to enter. We are up in Canada.

The question I have is can we just drive to the nearest border crossing in our car with canadian plates and apply for landed status even though we are not moving completely...will return back in a few days and will return again since we need to apply for re-entry permit for 2 years. Personal reasons for it.
Does one have to move completely to the US to land at POE? Does car crossing make it any different since we still have the car with cdn plates?

Second question...if my spouse decides not to take the greencard at all...does it mean that I cannot get it either? since we got the imm visas as a family or does the whole family has to land for all to get the GC. If I alone land at POE I assume I am the only one who will get it?

If you're only intending to be in the US temporarily, I think CBP could deny you entry. Whether they will or not is another question.

Who is the primary applicant, and what category did you file under?
 
Hi real canadian...

I am the primary applicant under family sponsorship F4.

Another question is if we do go by road and they do not let us in...can they
revoke our visas or just turn us back that case we may fly down ?

They understand that you might need a few months to clear up your personal and other business in your home country and get fully settled in the US, taking several trips back and forth. Your problem is wanting to get a re-entry permit right away. Even with a re-entry permit, you need to maintain ties to the US to keep the card.

I think you can bring the car in and change the Canadian plates to US plates (you probably will be expected to do so, as a green card holder), but some additional paperwork is needed. See http://www.canadatotwincities.com/bring_car.html
