Hi,

I am green Card holder from 2003. I will be eligible for submitting the N400 in Dec.
Last three years i have been making freq trip Outside USA.
Here are my trips
1. 5 1/2 months trip in 2005 ( apr - Oct)
2. 4 months trip in 2006 ( Jun - Oct)
3. 2 months trip in 2007 May.

I'm also planning to make one more trip of three months from Sep -Dec and apply N400 in a week after arrival. Will it be a problem. I have permanent job in US and they are sending me for 3 months trip outside US

Can apply for citizenship. We IO question my Intend.I have moved out of my apartment and gave my friend's address as mailing address.

Please Advice.

You will have 14.5 months out of the US if there are no other trips beyond the listed ones and the upcoming one. That is fine as far as physical presence in concerned. Will the officer question your PR status? I doubt it but there is always a small possibility. If you have maintained a job and dwelling in the US since 2003 and continue to maintaon one up to the day your take the oath, I see no issues. Good luck!!!

Thanks for your Reply.

Yes, I have been maintaining same job from last 10 years. This is same company which filed for my green card. I do not have any plans to leave this company till oath cermony.

But, I have stop leasing apartment from last to months and staying at friend's place( no lease agreement)> will this be a problem if we dont have lease agreement.

Thanks

Can I go out of US after submitting my application for month or two.
The Fingerprinting Notice may very well come quickly. Mine was sent the same day as the Notice of Action. It seems that some Service Centers have slowed down and send the FP notice weeks after the Notice of Action however I would not bank on it. You would need to be prepared to return to the United States on short notice.

Your trips all seem to fall within the range of allowed time limits out of the country. That should not be a problem.
What may cause trouble is the lack of proof of residence. If at all possible get your name added to the friend's lease, it is simple to do at the apt rental office. Or even put your name on his utility bills like garbage or cable.
Read the n400 manual to get a better idea.

Hi Citizen_Dec2007 and others

I have a slightly similar case as you and had consulted a lawyer about this. Reading about your absence from the US, it seems perfectly fine to me.
Especially since its your compnay who is sending your abroad and they are all under 6 months.

Now, I have a question for myself as my case is a little more complicated.

I got my GC in March 2002.
And here are my trips abroad for personal reasons.
April 2002 to August 2002 (5 months)
June 2003 (1 month)
Nov and Dec 2003 (1 month)
Feb 2004 (1.5 months)
June 2005 ( 2 weeks)

Even with these trips, I have calculated that I meet the physical persence and continuous presence requirement completely until April 2006.

April 2006 onwards I am pursuing a Master's program in Germany. I have the required travel document for 2 years. But I am still making trips back to the US every 6 months.
Therefore I returned to the US as follows
August 2006 for 2 weeks (under 5 months)
Feb 2007 for 2.5 weeks (under 6 months)

And now I am due to return by Aug 17.

Now I have 2 questions:
1. I would have returned much earlier but my father got diagonised due to cancer. Because if which I could not return until now and have to stay in India.
Now the only ticks that are available are after Aug 22 which makes me overdue by a few days. But shouldn't this be OK if I have a 2 year travel document? Which means that I dont need to return to the US at all for 2 years, but I can if I choose to do so??

2. If I am late by a few days ie I return on Aug 24th, should this be OK while filing for N400 since I have the travel document?

I had checked with a lawyer in SF regarding applying for the Master's program and he said it was ok, so long as I have met the physical and continuous presence requirements and I have a travel document and I keep returning every 6 months. Then there should be no problem while applying for US citizenship.

Now it seems like this time I may not be able to come back within 6 months and there might be a delay for a few days.
I am wondering if that is OK, since I have a travel document?

Any inputs will be great...........
And good luck ye all for ur processes.....
Bhawna
