There is currently no visas available to proces your i-485

Hello guys, i am new to this forum. I am writing on behalf of my mom. It's my first time visit here and i will provide as much information.

We have a bunch of dates. I will provide other dates if needed.

i-485 application to adjust permanent resident status.
Receipt date November 3, 2006
Notice date January 19, 2008


How much longer is the wait/estimated wait? How much longer from sending evidence stage to decision stage, since the uscis website states that decision will be made in 60 days. The evidences were recieved on September 3, 2010.

What category do we fall under? My dad is a Filipino nurse.

Are we still in status since our EAD expired on Nov 17th? We will be applying for EAD ASAP.

Any information regarding our case is greatly appreciated. Thank you very much

Who petitioned for whom? What is the basis for the immigrant visa? Is it employment based or family based? What category is it? Who is the principal and how old are the dependents/derivatives.

When was the petition filed? Was there a LABOR CERT.? If yes, when was that filed?
 
Nurse petitioned by employer. Section 203 B 3 A 1. Skilled worker or Professional. Principal is my Dad the nurse. The dependents are my mom, and 3 children. Mom is 53, children are 23,21,and 20. We have no labor cert. EAD was renewed 3 times.
 
The DECEMBER 2010 Visa Bulletin at http://travel.state.gov/visa/bulletin/bulletin_5197.html shows that EB-3 is currently being processed for priority dates BEFORE February 22, 2005, for people from P.I. The DECEMBER 2009 V.B. showed June 1, 2002.

The petition was filed by the employer. Are you showing dates pertaining to an I-485 or I-140? The filing date of the Labor Cert (used as the basis to file an I-140) is the priority date. You need to have the correct priority date in order to read the Visa Bulletin.

If the date shown in your post as the receipt date is actually your father's priority date, then he must wait until the Visa Bulletin for EB-3 (P.I.) progresses PAST November 3, 2006. It is always a "wait and see" for the Visa Bulletin. Everyone hopes that dates only move forward BUT they can also go backwards (retrogression).

The normal rule is that a child only remains a child for immigrant visa purposes while unmarried and under 21 years of age. The Child Status Protection Act offers SOME help for CERTAIN "aged-out" children. The CSPA is complicated and requires good math skills to figure out.

So in our case even though the website says decision will be made in 60 days, its actually more than that? So we just need to wait and see like you said. And just renew our EADs whenever it expires? And do the finger printing whenever USCIS tells us?
