The late receipt and the impact to status

Hi,

My PD is current on September. My current H1 visa is going to be expired on Oct 1st. My attorney sent both H1b Extension and I-485 on September 10. So far both receipts do not arrive yet. What is impact on my status if neither receipts come on October 1st ?

So long as USCIS received the petitions before October 1st, you remain in status. The generation of the receipt does not confer any status; USCIS' receiving your petition does.

It took USCIS two months to generate my I-485 receipt notice.

The H1B extension is failed to reach UUCIS before current H1B expired

Hi RealCanadian.

Due to the my lawyer's mistake , my H1 B extension is failed to reach the USCIS. However the I-485 got delivered. My current H1B is expired on this Octobe 1st. My question is can the I-485 delivery confirmation (not the notice of receipt) be used as an excuse for my coming out-of-status :-((
