The IO messed it up. What should I do?

I went for an interview today and the IO had very very bad attitude. She said something that I didn't hear and asked her to repeat, but she got very very mad.

She asked if I have tax returns with me I gave her the 5 year transcripts I got from IRS. Then she asked if I owe any tax, I said no. She asked if I have the document to proof it. I said it should be stated in those transcripts. She said I will get back to that later. Then she tested me English and 6 questions which I answered all correctly so she didn't bother to ask the rest of the questions. At the end, she said she can't approve my case, she will give me the documents I need to bring. She asked me to wait at the waiting area and give me a document to come back again in 40 days and the document she needs is the proof that I don't owe taxes. She didn't even bother to look at the transcripts that I don't owe any tax? What should I do? They already have the documents. Should I schedule the infopass? Again, she had very bad attitude and I just didn't want to upset her more at the interview.
 
Contact the IRS and get a statement (not transcript) showing you have a zero balance. Did you get the IO's name? If you found her to be unprofessional you can file a complaint with USCIS.
 
do not wait for 40 days. Get a letter from IRS that no tax is being owed. Submit it either by hand or by post with delivery confirmation at the earliest. Infopass is of no use.
 
I actually got a re-interview letter with date and time, just like a normal interview letter. If I mail the tax statement, I still have to go for the re-interview anyway, right?

I guess the IO was just tired and wanted to go home because I was almost the last person for today.

The thing that annoys me is that the interview letter doesn't even say anything about tax documents and my extra effort to bring the transcripts still didn't satisfy them. It seems they think they can do anything they want and treat us like dirt.

Did you get an interview results letter (n-652) at the end of your interview?
 
I am sorry for wrong advise. Please do not mail or hand over the letter you get from IRS. Please carry it with you for the scheduled interview.

After getting the letter from IRS you can try Infopass to reschedule your interview to an earlier date. Check whether walk-in infopass is available at your location.

That won't help the OP if the second interview is more 40 days or more after the first interview. There's nothing wrong with sending (by registered mail) the tax balance letter from IRS to USCIS and then following up with during the second interview.

No, I didn't get N-652. However, I saw she ticked at the choice of the case couldn't be approved or something like that (not sure the exact wording.) on a document (probably N652). But she didn't give it to me.

I got 2 papers. One is a list of documents that I need to bring for the next interview. The other is similar to the interview letter, except it says Re-Interview, specifying the date, time, etc.

And like I said, she probably just wanted to go home. She didn't ask me anything else other than going thru my app, then the history and English tests.

Just talked to the IRS rep, he said his department can't produce that statement. He can only give me transcripts of tax returns and transcript of my account, which he doesn't know if it even say that I have zero balances.

The account transcript should show any money owing. Owing money to the IRS in itself does not preclude someone from citizenship. However, purposefully failing to pay taxes in the past can.

By law they are supposed to give you interview results letter. Some IOs do not follow procedure and simply state you must come back (which really shouldn't be the case). The IO was supposed to give you the N-652, even if it said decision can't be made.

Btw, was your IO an African American woman at the New York Federal Plaza building?

That's the wording, decision can't be made. I guess you're right, she didn't follow the protocol.

No, she is a white.
 
After spending about 2 hours on the phone (mostly waiting) with IRS, I finally found someone who can issue the letter. However, he said it's an unusual request and he doesn't understand why USCIS wants this letter if they already have the tax returns transcripts.

You can also ask them for an Account transcript.

What IRS normally sends is basic transcripts. So ask the IRS to give you an account transcript for all the 5 years

Yes, I did ask for the account transcript but I don't know what it really is, so I didn't specify the periods. Should I call them again to clarify that (another 30 minutes wait)?

The letter I mentioned above is a customized letter saying that I didn't owe any tax to IRS between 2002-2009. Wouldn't that be enough?

I may be wrong, but I believe the account transcripts will show your balance.

If you already asked for customized letter, then I think you should ot worry about your account transcripts anymore.

At the end, the burden of prove is on the USCIS. They will have to prove that you owe money to the IRS if they wanna to deny your application...so if you don't owe any money, don't make too much of it...Also It is possible that the lady may have some information in your record..so make sure that you are clean with the IRS

Not quite. The burden of proof is on the applicant to provide the documentation requested by USCIS. If the applicant doesn't provide it, then the application will be denied for lack of requested documentation regardless of whether USCIS can prove the applicant actually owes taxes.
 
Thanks to all the advices. I've now requested all documents the IRS can provide. Wish me luck for the re-interview...
