Texas SESA tracker

Even if our cases from Enterject (Texas SWA) would transfer to the Dallas BEC, can we still convert them to PERM based on the fact that nothing would be done regarding the LC till March 05.
I am saying this because PERM regulations state that you can convert your current pending case if no job order has been opened yet for that LC.

Any thought??

actually am a physician and mine comes under EB2.
1.how long do u think it could take BEC to process labor if my RIR went to DOL ATL in aug2004.
2.also would anyone know, can i file for 140 /485 even if my labor has not been approved yet

Master Tracker

Hello all,

I am trying to create a master tracker that will help all of us determine where we all fall in the BEC queue.

My goal is to consolidate into a single tracker all pending labor certifications from all STATES and all DOLs.

This will help us in the long run to better understand how BECs will be processing our cases.

I have attached an empty tracker. I will return next Friday, February 11 to “pick it up”.

At that time I will merge all sub-trackers into a single one and post it in the DOL forums section.

I hope you find value in doing this and participate. If your forum has a tracker already, it would be great if someone volunteers and populates the tracker I have posted.

Since it will be hard for me to check all forums next week, if you have any questions, please send me a Private Message.

Enterject (Texas SWA) cases moving to Dallas DOL

Have any of you with pending cases with Texas SWA (TWC in Austin) or wth Enterject have received 45 days letter from Dallas BEC.
Does anyone know what has happened to Enterject files after the contract was terminated ?

How is Backlog center transfers working ?
Are they making any progress in LC cases pending for more than
2 years now with them ?

Got an RFE from TX

My Priority date is May 2003 and I received a RFE on January 10th 2005. Im filed under EB3 regular. Any ideas what the status on this kinda cases is?

Does anyone has an update on whats going on with cases pending at TWC which could not make it to the DOL....I am assuming by now all of such cases have been transferred to BECs and I was wondering if anybody received a 45 letter ...My PD is Nov'03 filed under EB3 regular/non-rir. I received a RFE from Interject in Dec04 and my attorney told me that the RFE had to be responded to TWC as Enterject's contract had expired in Dec..RFE was responded in Jan'05 but haven't heard anything since then.....Just wondering if anybody in a similar situation has more info....

Its been almost 4 months since my lawyer told me that they received and responded to RFE from Enterject. On Friday, I checked with my Lawyer, and he said he has not received anything from TX SWA. I am not sure why no one has received any 45 days letter and why this thing is getting delayed over and over and over.
 
Have all " work in process" Enterject cases moved to BEC ???

Can you plz ask your lawyer to confirm if all " work in process" Enterject cases have been moved to BEC ? Last I hear they were all supposed to have been transferred on 4/22/05.

Hi Texancanadian,
Lawyer has no clue as well. Even he is in Texas, he has no connection to D-BEC, what the heck!. As far as the transfer is concerned, DOL today published in its website all the Q&A that we have been waiting for. BUT there is no indication about the Enterject cases, what happen to it, where is it and stuffs. Soon I get any smell about the SWA cases, I will let you know and please do the same bro. I received case number from Dallas-BEC in response to my email request to them on April 14, 2005. Mine was RIR remanded (kicked backed) case from DOL-Dalls to TWC. Hope to get 45 days letter soon and get case moving after 4.5 plus yrs of waiting. My PD is August 2001.

The purpose of this letter is to acknowledge your request regarding the status of the above-referenced case.

The new case number is: D-05109-6XXXX
The above-referenced case has been transferred to one of the Division of Foreign Labor Certification’s Backlog Processing Centers. At this time, we are unable to provide any additional status information on Permanent Labor Certifications. All Processing Center files are in the process of being transferred into a new database. Once the data entry process is completed, a 45-day letter will be issued on all applications and additional information will be requested from the employer if needed.
Please do not request additional status information for at least 90 days after responding to the 45-day letter.

Today I added the 600th record to the tracker.

There are 419 records for people that made to Regional DOL
The rest are SWA records which tells me SWA people are still underrepresented in the tracker.

The tracker includes reports that may answer some of your questions so do please take the time to look at the reports.

I would also encourage you to review your info and post updates especially if I have missed your 45-day letter.

RIR-EB3 returned to Traditional

Hi,

My case was filed on 2002 Mar, End of 2003 it went back to traditional processing, saying there are a lot of lay offs in this region(Dallas-Texas).
I heard that it is with the contractors(Enterject or something).
Any Idea when can i expect or what will be the status of my application.

I wish I knew

I wish I knew. I have no clue. All lawyers say is wait - which I have been patiently since 4.5 yrs. They say things will be clearer by end of September so God knows.
