telling immigration and officer my wife worked illegally

ok i am getting different answer from lots of people on this (lawyers from my side say that she worked, but a lawyer from her friend said other wise). first off my wife is from brazil and she came with a J1 visa as an Au Pair.Her visa expired in july of 2008 but she conintued to work till present. She also applied for tourist visa in july of 2008 but wa denied but stayed and worked as au pair for family. so what does everybody suggest, inform about her working here or say that she discontinued working in 2008. this is tough one any suggestions or advice would be appreciated
 
You have attorneys representing you. Follow their advice. The lawyer for your friend does not have the proper information to make the most correct assessment of your wife's situation.

Lying for an immigration benefit will create far more problems than telling the truth even if it includes admitting to illegal work. Rule # 1: Do NOT lie to immigration.
 
well, i was in the same situation-overstayed J1 visa for 2 years and was working all that time illegally. But i was also stupid enogh to trying use my income for the affidavit of support. well, at the interview i was really nervous, cuz they had all my information regarding my current job, but as i understood, IO didnt care too much. he just asked me to verify the address of my current employer,because on the forms i put the HQ address instead of the actuall physical address.
i dont think you should worry but if they ask-dont lie.
 
well i can see the relation to your case neamorfnost but she applied for a tourist visa which may make her situation worse than just having expired J1 visa so they may say she lied, well dont have an attonrey but will speak to another but hoping for a cool immigration officers
 
First I think she should renew her visa before it get expired. She should consult a lawyer for you case because she could also get deported once that she stayed long without the right visa.
 
Actually, i didnt mention that, but when my J1 expired, i applied for B2 visa, which was never approved. they didnt receive some papers, and i moved and received the letter infroming that they needed smth else to late and decided to leave everyth like it was.
so i think shell be ok!
 
Nothing good is here. If visa is expired and she did not leave the country, she is automatically inadmissible for 5-10 years to reenter the country after she leaves. The only way to stay here is to find US Citizen and marry. Otherwise, once she gets caught (with a crime) she will be deported.
