TD Visa Stamp and Passport Expiration

Hi all,

I'm a Canadian citizen living in US on TN status and my wife is a Chinese citizen living with me in US on TD status. My TN has been extended to July, 2012. My wife's current TD visa stamp has expired. She has a TD visa appointment at the US consulate in Vancouver, BC on August 10th. On the visa appointment confirmation letter, it says, "To be eligible for a visa, your passport must be valid for at least 6 months past your intended stay in the United States." However, my wife's passport will expire in Feb, 2011. Since the passport expiration date will be before the expiration date of my TN, will that cause any problem? Thanks in advance.

It shouldn't. Of course, the consulate reserves the right to limit the visa to Feb 2011, or even six months past (yes, past that date) to Aug 2011.

Superjk, how did your wife's appointment go? Hope it went smoothly.

It sounds like your wife can travel to Canada on a tourist visa. Can you share you experience getting that? Any difficulties? My wife is now in the U.S. on a TD visa with me, but back when we were in China, we were unsuccessful applying for a Canadian tourist visa for her. The reason they gave was that we were married, and hence they were not satisfied that she wouldn't stay on illegally in Canada, and they recommended that they apply for PR instead.

My wife's visa interview went well. She received her visa two days after her interview and we returned to USA immediately after receiving her visa. My wife does NOT have a tourist visa to Canada. She is a permanent resident of Canada. I sponsored her Canadian PR status while I was in USA and it got approved. She came to USA on a B2 visa first and then we drove to Canada last year to land. The Canadian immigration process took about two months from the day I filed her paperwork to the day she interviewed for the immigrant visa and got approved on the same day. I'd recommend you to apply for your wife's Canadian PR ASAP. Hope it helps.

Thanks for your advice, Superjk. I've also considered applying for PR for my wife. However, looking at the form, I see that it is asking me for my "Record of landing/confirmation of permanent residence number". Perhaps you can help me on this -- do you happen to have any idea what that is? Would you happen to know if I really need to fill that in? I have been living abroad for many years, and only have my citizenship card and passport with me. I'm hoping I don't have to go back to T.O. and look through n boxes in storage just to find this one number. :)

It's a number on your landing paper. I kept my old Chinese passport and was able to find the number on it. If you don't have it, I don't think it's a big problem to not fill it in.

I sponsored her Canadian PR status while I was in USA and it got approved.

Superjk,

I am in the same situation as you are. I am a Cnd citizen but my wife is not, as well as our newborn son who is a US citizen only.

If it doesn't work out for us to stay in the US due to the slow and difficult perm process, I would like to move back to Canada with my family.

My understanding that sponsoring your wife for Cnd PR would require more time and I would need to show my Cnd income to be able to do that. If I live and work in the US as a US resident having 0 CND income, can I still sponsor my wife for PR? Please respond, if you want PM me, this is very important for us. Thanks in advance.

You do not have to show Cdn income, you must however show that you are currently planning to return to Canada.

Thanks Nelsona.
I knew some people back in Canada who married women from overseas and it took them a couple of years of paperwork and hassle to bring them over. They had to prove their income and everything.

I will definitely do some research on that issue on the web, but in essence, what is really different sponsoring your spouse from the US vs from overseas? I mean from the Cnd immigration law, there should be no difference, except for proximity to Canada maybe, that allows faster processing versus going through the main immigration backlogged channels or whatever they call them?

Overseas is a generic term for foreign country. No difference between US and madagascar.

When I said you don't have to prove Cdn income, I meant that your icome could come from any source.

It took me and my wife about a month to get all the paper work ready and two months for Canadian government to approve my wife's immigrant visa. I sponsored her from China while I am in USA.

As far as the Cdn income goes, as Nelson said, Canadian government does not really care the source of your income as long as it is from legal source. Your income from US is perfectly fine.
