TD Visa question for my son in TN new employer transfer situation

Hello,

Both me and my wife currently on TN . We got our first TN in April 2013 . That time there was no online I94 so on the PP , I94 for my son TD it was written both mentioning me and wife's name. My wife changed employer and transferred TN ( via mail ) last year but did transfer for herself only excluding my son as her dependent. I am now in process of changing employer as well . My current TN is valid until January 2018. my questions are :

Q: Do I need to get my son TD transfer as well with my TN transfer for the new employer? Or his TD would be fine based on my continued TN status . His TD is valid until end January 2019 when my current employer TN would be expiring as well.

Your son's TD status is dependent on EITHER of you maintaining ANY TN status, not a specific TN by a specific parent.
So, your only concern is that his TD not expire (did he get a new one sometime since 2013, as that one has certainly expired). You should, if it is convenient (and he is Canadian), have his TD extended next time he crosses the border, to match up with TN which has the expiry date furthest in the future, but as long as you remember to extend his TD when you extend your TN, that is sufficient. (your post states that your TN is expiring in Jan 2018, and then Jan 2019 - make sure which).

And always remember to print any new online I-94s that your family gets.
