TD visa holder going through divorce in North Carolina

Hello....

Not sure if this is a duplicate message.....
I am a Canadian citizen who has been living in the US on a TD visa for 10 years. I am currently getting a divorce from my husband a registered nurse. I have been a stay at home mom for our complete marraige with working occasional part time in Canada.
I have remaining child at home who is 17 and will turn 18 in March and graduate in June.
I am planning on heading back to Canada after graduation.

I am not sure if I should get a lawyer here in North Carolina or in Ontario where I plan to reside. Laws for stay at home moms are limited here. Canada supports Stay at Home Moms better. I beleive.
Can he claim domicile here and make me go by North Carolina laws?
I feel we never get a brake on anything being a non resident here but for this I am sure they will gladly look after us as we are considered "legal aliens" or legal non residents.
I am scared alone and frustrated.
Please any advice would be greatly appreciated.
 
Once you divorce, you have no longer the right to live in US. Period. Your TD status is invalid at that point. You will not be a "legal non-resident" at that time. Your son vcan remain on TD status until age 21, although he would probably switch to a student status when going to college. Any other issues are not immigration related and best be discussed with a divorce lawyer, but I might suggest that you delay divorce until your son finishes high school, so that he can then make his own choices as to whether he wants to stay in US or go back to Canada with you.

But you will be moving back to Canada, not much choice about that, unless you get your own work status.
 
Once your divorce is final, unless you arranged another visa, your H4 status expires and you have to leave the country immediately. This is the gist of it. Seriously???? You do realize this is a 6 year old thread and the discussion is not even H4 related. By the way, don’t try to use this forum to advertise whatever service it is you offer - consider this your only notice.
