485 Not a priority
Now more effort on H1 and EADs
 
Why does only CSC not have 485 as priority? Whats in their mind? They definitely are not dumb. Is this all calculated? Why? What does BCIS get if only one SC delays 485 and another (VSC) goes on doing their business as usual. If they don't want more Green Card Holders they would deliberately slow it down across the board. Whats up? Someone should directly ask CSC officials as to when this whole 'slow' thing would end.
 
I think its time for action .. some protest or whatever . Else we will remain in this forever. I485 has not been a priority for 8 months now.I dont know why the lawyers can't ask why its not a priority for Gods sake they have cases pending for close to 2 years now!! Atleast in H1 one can choose Premium and EAD one can get IEAD. Whats for 485 ? Don't these guys have common sense? And do these lawyers just go there to listen to this BULLSHIT month after month.

Any suggestions on what we can do?
 
As I had said earlier, this government is anti-immigrant. What can you expect from the likes of John Ashcroft? Unfortunately, we belong to a crowd that has no political clout. No congressperson stands to benefit by supporting people with no voting rights.

When we accepted the receipt from INS/BCIS for our 485s we also accepted that it might take upto 999 days to process this type of application. I do not know how feasible this is but here is something to think about: If we have a sizeable group on this forum who have passed the 999 day mark, we can make a legal claim that the service was not rendered as promised for the fee paid. This may get the BCIS to atleast think about the rest of the crowd. This has to be done in consultation with a lawyer and may not even be possible to do. This is just a thought i want to throw out there for a discussion in this forum.Just reading through the forum I doubt there is a large collection of applicants past that waiting time on this forum.

Alternatively, we could as a group become somewhat influential by making political contributions as a group to a senator for the upcoming election campaign. This may or may not benefit us but atleast future applicants may reap the benefits of what we sow now.May be worth a shot.This may also turn out to be a gamble with no benefit whatsoever to any one.In this country, lobbying as a group is everything. Any thoughts, group?
 
Because Lawyers do not benifit anymore after that point

Lawyers collect all the legal fees upon I-140 apporval. Therefore it is not in their interest to advocate higher priority for I-485.
 
and lawyer collect more fees for H1b renewals and more fees for AP renewals and more fees for EAD renewals - so who in gods name hasn't thought that maybe the lawyers ARE PAYING the INS to NOT MAKE i485 a priority !!!!!!
 
This wait is terrible but sooner or later they must make approving GCs a priority so I'm starting to get a little hopeful. There are more than a million I-485s pending and only 400,000 EADs pending. Eventually they are going to have to address the GC backlog.

What is the basis of your prophecy? Clearing EAD doesnt mean they get to 485 next. But I wish they did. I would like to see something on the likes of "your EAD is denied because the underlying 485 is approved!"
 
My conspiracy theory says CSC started to clean EAD backlog only because of complains from district and sub office. Interim EAD created a huge workload for those offices and CSC decided to process EAD.

The data is, EAD backlogs being cleared, and the pace they are being cleared at versus fresh filings.

Once EAD backlogs are cleared .. they don't have anything else to do .. and yea ... 485 backlogs are HUGE enough at this point to cause even them a worry.

Just to give you an idea, NEVER in the history of INS has 485 backlog been so bad. I think they will address it sooner or later, but then again .. this is INS we are talking about.
 
The fact that the liason person said that 485 is not priority means that they are not terribly concerned about the backlog. It may just be our wishful thinking that they may soon be worried about the back log.

I'm no prophet and I didn't suggest that 485s were "next." I just pointed out that sooner or later approving GCs would be a priority because the backlog of un-adjudicated applications is growing. I agree with SM that the 485 backlog is huge and growing by the day so eventually will have to do something about this.
 
BTW on the last count I saw a few 02-12xxxx approvals for EAD's which means late january once feb is done at this pace in about 1 -2 weeks maximum they will be <90 days on EAD then what ??back to twindling thumbs?

SM dont tell me they will have nothing to do.. How about a Volcano in azerbhaijan requiring priority!
 
CSC has been misleading for the past seven months with a variety of excuses. Looking at the most recent reports they are down 26 percent in approvals year-year. So to say 485 are no longer a priority is an understatement of reality. Immigrants no longer matter in this new economy. And there is not much we can do besides survive and wait.
 
Immigration issue seems to be another lagging indicator of the economy. You will see unemployment and jobless data still go up even when the economy is turning around. Remember Oct 1999, when the congreee approved the AC21, at that point the economy was already in full bloom and on the way to bust. So I am not expecting I485 to back to normal for another 2 -3 years.

As to the current approval speed, as I always said that speed will probaly goes up once Bush is gearing up his re-election campaign. BUT, some congressmen will very likely to address the H1B issue and use it as a leverage for their re-election. I am pretty sure that someone will introduce some motion in the House of Representatives to limit the foreign workers in USA.

Frankly I do not know what they are going to do. If we survive, we survive and we join the free labor force for another period to prosperity, otherwise we will probaly be stuck with the same company for quite long time.

So do we really want them to speed up the 485 and approve anyone without carefully examining their background. Their excuse is to prevent the immigration benefits falling into the wrong hands. It seems very convincing and I am sure that I do not want the new BCIS to let in another terrorist. If a terror attack happends again, we foreign workers will probaly suffers the most.

Our fate and destination is strongly tied to the US economy. All the reasons behind the h1b issue was based on the fact that US is short of hi-tech worker. Now the situation has completely changed and I think it should be understandable that BCIS is slowing down the process.

Anyway, I still hope that they speed up but I am more concerned that they do not let in another terrorist.

You are living in a fantasy world of concerns. First of all how many bad guys(tr) will come here on a H1B visa? and wait for 3- 4
years for immigration benefits ?

even so, they have so many background checks to determine this? Why would a such a person long for immigration benefits?
In any case ,those who are already here are here.. like it or not.By slowing the GC process how does it help anyone? This is nothing but discrimination of the White collar type.
