Taking so long for interview

My receipt letter was July 23, 2009 and FP July 30, 2009. I received a yellow letter on Sept 25, 2009 telling me to bring my driver license to the interview. It is November 29, 2009 and no letter yet. My online status state waiting on evidence, which has the same date as the FP. Also, on the online status it has August 13 as a reviewed date. I called the customer service line but all I get was the recorded message. I made an Infopass appointment and all they told me was that my file is still at the service center and it can take up to a year. What is my recourse in getting a status on this, I'm thinking they have misplaced my file and forgot about it. Any advice will be appreciated.

INFOPASS is the best way - try to speak to a 2nd level officer.

Other option is to call FBI and confirm that the FP results were indeed sent back. I saw a post recently where someone said FP stopped responding to name check results, but still respond to FP. No harm in checking both out.

See my timeline below. I am in the same boat. The last time I checked (a month back), the Chicago DO requested my A# file on Oct 4th (don't know where it is currently located but I am predicting it could be at Nebraska Service Center where my I-485 was approved). I am still waiting for my interview schedule. Few things you need to know here. 1) It is a lie when when they say that it could take upto an year to get the file from the service center. The 2nd level IO I spoke to told me that it could take anywhere between 45 to 90 days to get the A# file after request. 2) IO can proceed with interview after waiting for 3 months trying to get the A# file. 3) Official processing times on average for any DO is 5 months. How can they say that it could take upto an year between FP & IL for some cases? 4) My "prospective" lawyer know my case timeline and he asked me to get in touch with him in January first week if I don't hear from USCIS regarding interview. He said starting Jan 2010, I will have valid reason to pursue the case strongly through a lawyer.

Unless you committed a very bring crime that has national security implications, stop worrying about background check from FBI. FP & namecheck by FBI are done pretty fast these days. If the Infopass tells you that they are waiting for your file, you can safely assume that necessary feedback from FBI is already done.

I suggest you put your detailed timeline in your signature, including your DO. Also, when you say 08/13 was the review date, what do you exactly mean by "review date"?

Also, you might consider joining the following thread specific for FP to IL waiting people. I opened it long back for victims like you and me :) It's easy to track things there instead of looking at multiple threads. Also, please check your private messages inbox folder.

You can also ask your state Senator/Representative office for help. It does not cost you anything.

And they don't do anything either. You'll only get a standard letter telling you exactly what the status of your application is. Which, I'm assuming you already know. Don't expect them to do anything for YOU. There are many like you who write to them, they don't have the time or efforts available to them to make your case 'special'. Just expect them to tell you what stage your case is at. If you want anymore then take a different route.
 
BritishGuy, I did not say this will make OP's case "special" or the Congressman/Rep offices have superpowers....If i was on the same boat, i would still give a try to all possible avenues..it costs nothing. You never know...Why would not try ? It will not hurt and harm the case. Many congressmen with large immigrant population have devoted staff to deal and help immigration benefits applicants...
 
I agree with BritishGuy when it comes to contacting reps or senators. Unless you are looking for information, Rep or Senator will not help you . I am amazed to know that they really got no power when it comes to USCIS.
 
Don't expect anything more than a generic response from congressperson and/or Ombudsman if your case is within the posted processing time of 5 months.
For now the OP can request customer service to open service request or schedule another Infopass and request to speak with a supervisor. If there's still no movement after the 5 month processing threshold, then congressperson and/or USCIS ombudsman is next route.

That is correct, but if you aren't getting progress or useful information you can usually get your Congressional office to try and get more detailed answers.

I am amazed to know that they really got no power when it comes to USCIS.

What powers should they have? If you have been studying your citizenship materials you will have learned about the "Separation of Powers". ;)
 
I think the best thing for me to do is wait till my 5 months period end and if still nothing then schedule another Infopass and send letter to USCIS.
 
Update from Hawaii

Today I called the service center and to my surprise they were very helpful. I told them my situation about my status being stucked for over 60 days and have not received any request for information except for the FP, so she transferred me to an immigration officer. He got my file and asked me whole lot of questions to verify I was the one calling. He told me that reason for taking so long was that Las Angelas office is merging with some other office and my N400 missed the October cut off, so he said I should get an interview letter within 45 days.

Now, do I understand what he was saying, not really but I'm just happy it is moving now, hopefully. I was afraid my file was lost or forgot about and hopefully my call will re-energize it.
 
Hi! I had the same delay with my interview. Info pass was not helpful at all. Rajiv advised me to seek help from US Rep. I requested my US Reps office to look into it and within a week I had my interview date. They said they did not know why my case had been suspended, but is had been...please call your Representative. I just had my interview today in Santa Ana:-)

Could you please post your timeline here. I am wondering how long you waited after giving FP before you approached the local US Rep. for help? Also what was the reason USCIS stated initially for the delay before you contacted US Rep.?
